Naming of Proposed Public Streets

True Davidson Drive and Hampton Park Crescent

(City Council on July 6, 7 and 8, 1999, adopted this Clause, without amendment.)

The East York Community Council recommends adoption of the following report (May 12, 1999) from the City Surveyor, Technical Services Division, Works and Emergency Services, subject to amending Recommendation No. 1 by deleting the words "Governor's Hill Drive" and inserting in lieu thereof the words "True Davidson Drive":

Purpose:

This report recommends that the two proposed public streets at the new subdivision located south of Nesbitt Drive and west of Bayview Avenue, be named "Governor's Hill Drive" and "Hampton Park Crescent."

Funding Sources, Financial Implications and Impact Statement:

Not Applicable.

Recommendations:

It is recommended that:

(1) the proposed public street located west of Bayview Avenue, extending southerly from Nesbitt Drive, be named "Governor's Hill Drive";

(2) the proposed public street extending easterly from Governor's Hill Drive, be named "Hampton Park Crescent"; and

(3) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Council Reference/Background/History:

Councillor Michael Prue has requested that I report on the submission from Cathie Gilbert of Jasamax Holdings Limited (60 Tiverton Court, Suite 300, Markham, Ontario L3R 0G4) to name the two proposed public streets in the proposed subdivision located south of Nesbitt Drive and west of Bayview Avenue. The name "Governor's Hill Drive" relates to the Governor's Bridge, located near the site. The name "Hampton Park Crescent" is named after the original planned project for the site. Both names are variations of a list of names provided by the Governor's Bridge Residents' Association.

Comments and/or Discussion and/or Justification:

The proposed names have been circulated to Councillor Case Ootes, Councillor Jane Pitfield, Toronto Planning, Fire Services and Heritage Toronto. Councillor Jane Pitfield, the Planning Division and Fire Services have no objection to the proposed names. The submission from Cathie Gilbert, set out in Appendix "A," indicates that the Governor's Bridge Residents' Association and the East York District Planning Division support the proposed street names.

Conclusions:

The proposed street names "Governor's Hill Drive" and "Hampton Park Crescent" are generally acceptable and should be approved for use in the proposed subdivision south of Nesbitt Drive, west of Bayview Avenue.

As per our telephone conversation, I would like to request the street names for the above mentioned subdivision. There are two streets in the subdivision, for the crescent we request Hampton Park Crescent which is named after the original planned project for the site. For the main street we request Governor's Hill Drive named after Governor's Bridge. Both are variations of a list of names provided by the Governor's Bridge Resident Association.

As I mentioned, both the Resident Association and the East York District Planning Department have approved these names. Jean Besz of the Planning Department gave me your name to finalize the street names on the plan of subdivision.

Public Meeting Held in Accordance with the

Planning Act with respect to Official Plan and

Zoning By-law Amendments by Richard Wolfe

(City Council on July 6, 7 and 8, 1999, adopted this Clause, without amendment.)

The East York Community Council, based on the findings of fact and conclusions, recommends that:

(1) City Council approve the application by 850901 Ontario Limited, as amended, to amend the Official Plan and Zoning By-law No. 1916 for the property at 60 Overlea Boulevard to permit 106 parking spaces including eleven perpendicular front yard parking spaces with a two-way drive aisle as shown on "Alternative Design Drawing A-2", submitted by the Applicant;

(2) City Council enact the Official Plan and Zoning By-law amendments revised in accordance with Recommendation No. (1) and otherwise substantially in the form attached to the report of the Director of Community Planning, East District, dated May 31, 1999;

(3) the Applicant be required to install and maintain landscaping and watering systems to the satisfaction of the Commissioner of Economic Development, Culture, and Tourism; and

(4) no further notice be given respecting the Official Plan and Zoning By-law amendments.

The East York Community Council reports having held a statutory public meeting on June 22, 1999, in accordance with Section 17 and Section 34 of the Planning Act, and appropriate notice of this meeting was given in accordance with the Planning Act and the regulations thereunder.

The East York Community Council submits the following report (May 31, 1999) from the Director of Community Planning, East District:

Purpose:

This is a final report on the above application for front yard parking with a one-way drive aisle and a reduction of required parking spaces for 60 Overlea Boulevard.

None for the City.

Recommendation:

It is recommended that in the event that City Council decides to approve the application by 850901 Ontario Limited to amend the Official Plan and Zoning By-law No. 1916 for the property at 60 Overlea Boulevard to permit 106 parking spaces including 11 front yard parking spaces with a one-way drive aisle, City Council enact the Official Plan and Zoning By-law amendments substantially in the form attached.

Background:

Proposal:

The application, submitted by Richard Wolfe, on behalf of 850901 Ontario Ltd., pertains to a 6,185 square metre property located at the north-west corner of Thorncliffe Park Drive and Overlea Boulevard. In May, 1997, the applicant received site plan approval for the subject property for 94 parking spaces to the rear and sides of the building and a two lane driveway traversing the front of the premises. In February, 1999, the applicant submitted a revised site plan showing 95 spaces to the rear and sides of the building and a two lane drive aisle across the front, and in addition 22 parking spaces fronting on Overlea Boulevard which was reported on in the preliminary report dated March 5, 1999. The applicant is now requesting the City's approval of a new application with revised site plan showing in addition to 95 parking spaces, 11 angled parking spaces fronting on Overlea Boulevard and a single lane one way drive aisle. The new application requires amendments to the Official Plan and East York Zoning By-law No. 1916. According to the applicant, current lack of front yard parking is a major impediment to fully leasing the existing building.

Comments:

Official Plan Policies and Zoning By-law

Section 2.3.10 of the East York Official Plan prohibits front yard and boulevard parking for properties facing on Overlea Boulevard. Section 2.3.9 requires a minimum setback of 15 metres for properties abutting the north side of Overlea Boulevard but also specifies that Council may consider smaller setbacks for properties located at the intersections of Thorncliffe Park Drive and Overlea Boulevard. Section 2.3 also includes a variety of policies which encourage employment opportunities, walking, cycling, and transit use within the East York Centre.

The General Provisions for all Industrial Zones of Zoning By-law No. 1916 (reference Section 8.1.5) set out requirements specific to landscaping, including a requirement that all front and side yards abutting Overlea Boulevard shall be used for landscaping purposes only.

The Transportation Services Division of Works and Emergency Services has advised that 111 parking spaces are required to serve this development if it is fully leased to retail tenants under the provisions of Zoning By-law No. 1916. This is based on a ratio of 1 parking space per 4.8 square metres of public floor area for the restaurant component and 1 space per every 19 square metres of total floor area for the remaining retail component.

Initial Agency Circulation:

The original revised site plan which was reviewed in the preliminary report was circulated for input to all appropriate agencies and City Departments. The Economic Development Department and the Urban Design Division of Urban Planning and Development Services expressed serious concerns respecting the application. The two lane drive aisle combined with 22 front yard parking spaces replaced most of the substantial landscaped setback that currently exists between the front of the building and Overlea Boulevard The resultant design compromised considerable historical efforts that have been undertaken to present an attractive streetscape for businesses on the street. The north side of Overlea Boulevard is characterized by a uniform edge of buildings setback 15 metres from their property lines with areas in front of the individual buildings being landscaped like front lawns of estate houses.

Discussion

Planning staff concurred with the above comments from other divisions/departments and initiated negotiations with the owner to explore alternative design treatments which could incorporate some front yard parking to accommodate uses permitted within the existing building and the preservation of a significant landscaped setback. As a result of these negotiations, the owner submitted a new application with revised site plan in early May, 1999.

The new application is an improvement over the February 1999 site plan. The proposed 6 metre wide two lane drive aisle traversing the front of the premises has been replaced by a 3.5 metre wide one-way drive aisle. The one way 3.5 metre wide drive aisle meets the engineering standards of Works and Emergency Services and is necessary for access to the new proposed parking. The proposal now has 11 front yard angled parking spaces. These changes preserve the majority of the existing landscaped setback at the corner and a substantial landscaped area between the proposed parking and Overlea Boulevard. The five existing mature trees along Overlea Boulevard will not be jeopardized.

Approval of the revised site plan for the site also requires a zoning amendment to the landscaping requirements of the by-law and an Official Plan amendment to allow front yard parking on Overlea Boulevard. The Official Plan provides for lesser setbacks for the four corner properties on the north side of Overlea Boulevard at the intersections of Thorncliffe Park Drive. In addition, a site-specific amendment allowing limited front yard parking for 66 Overlea Boulevard was approved by East York Council in 1996.

In May, 1997, East York Council amended the Official Plan and Zoning By-law for 60 Overlea Boulevard to permit additional retail uses of a local nature. This amendment is consistent with Section 2.3 of the Official Plan which includes a variety of policies encouraging employment opportunities within the East York Centre. As noted earlier, 111 parking spaces are required to fulfill the zoning by-law parking requirement for 60 Overlea Boulevard if it is fully leased to retail tenants. The proposed 106 parking spaces including 11 front yard parking spaces accommodates almost all of the parking demand associated with already approved uses for 60 Overlea Boulevard. The proposed parking will require a site-specific zoning by-law amendment to ensure the owner can fully lease the building without having to seek a parking variance.

Site Plan Approval

The details of the design of the site will be reviewed in a separate Site Plan report which will be considered by the Director of Community Planning for the East District. The site plan approval will require that all work be undertaken in accordance with the site plan attached to this report and a landscape plan that will ensure that the parking is appropriately screened by landscaping.

Conclusions:

The attached Official Plan and Zoning By-law amendments implement the application by 850901 Ontario Limited for the property at 60 Overlea Boulevard to permit 106 parking spaces including 11 front yard parking spaces with a one-way drive aisle.

Amendment No. 20 to the Official Plan

For the Former Borough of East York

Part One - Preamble, does not constitute part of this Amendment.

Part Two - The Amendment, consisting of the text contained therein and the map attached thereto as Schedule "A" constitute Amendment No. 20 to the Official Plan for the former Borough of East York.

Preamble

Title

This is Amendment No. 20 to the Official Plan for the former Borough of East York.

Purpose

This Amendment concerns a 6,185 square metre property located at the north-west corner of Thorncliffe Park Drive and Overlea Boulevard. Its purpose is to provide a site-specific Official Plan Amendment for 60 Overlea Boulevard to permit 11 front yard parking spaces with a one way drive aisle. Section 2.3.10 of the Official Plan prohibits front yard parking for properties fronting on Overlea Boulevard.

Location

The lands affected by this amendment are outlined in a heavy black line identified as "Area Subject to Amendment" on Schedule "A" attached hereto, and are located at the north-west corner of Thorncliffe Park Drive and Overlea Boulevard. Their municipal address is 60 Overlea Boulevard.

Basis

Section 2.3.9 of the Official Plan which applies to the four corner properties on the north side of Overlea Boulevard at the intersections of Thorncliffe Park Drive, contains a general provision allowing lesser setbacks than other properties on the north side of Overlea Boulevard. The proposed Official Plan amendment is consistent with this Official Plan policy.

Part Two

The Amendment

(1) All of this part of the document entitled "Part Two - The Amendment" consisting of the following text and the attached Schedule "A" constitute Amendment No. 20 to the Official Plan for the former Borough of East York.

(2) The lands affected by this Amendment are shown on Schedule "A" to this Amendment as "Area Subject to Amendment."

(3) The text of the Official Plan for the former Borough of East York is hereby amended by adding a new Section 3.15.18.4, immediately following Section 3.15.18.3, as follows:

"3.15.18.4 Notwithstanding the provisions of Section 2.3.10 of this Plan, Council may consider Zoning By-laws and Site plan agreements for the property known in 1999 as 60 Overlea Boulevard permitting 11 angled parking spaces and associated one way drive aisle between the main wall of the building and the Overlea Boulevard street line."

Whereas the authority is given to Council by Section 34 of the Planning Act, R.S.O. 1990, c.P. 13, as amended, to pass this By-law; and whereas Council of the City of Toronto has provided adequate information to the public and has held at least one public meeting in accordance with the Planning Act.

The Council of the City of Toronto Hereby Enacts as follows:

(1) The lands subject to this By-law are those lands outlined by a heavy black line and identified as "Area Subject to Amendment" as shown on Schedule "1" attached hereto; and

(2) Zoning By-law 1916, as amended is hereby further amended by inserting a new Section 8.4.3 m) immediately following Section 8.4.3 l) as follows:

None of the provisions of this by-law shall apply to the lands identified on Schedule "1" hereto as BC- (14) and known municipally as 60 Overlea Boulevard to prevent:

(a) the provision of 106 parking spaces to accommodate full retail use of the existing building; and

(b) the provision of 11 front yard angled parking spaces between the front of the existing building and the Overlea Boulevard streetline and a one way 3.5 metre wide drive aisle between the existing building and the parking.

The purpose of this report is to seek direction from Council regarding appeals of the Committee of Adjustment decisions described below. This report is for the consideration of the East York Community Council at its meeting on June 22, 1999.

Recommendation:

It is recommended that this report be received for information.

(1) Variance Application A40/99EY

Mr. Peter Colarossi

Re: 150 Glenvale Boulevard

The applicant is proposing to construct a second storey addition and a two-storey rear addition to the dwelling at 150 Glenvale Boulevard. He applied to the Committee of Adjustment for variances from the maximum floor space index and building length requirements, and the minimum side yard setback requirement. On April 13, 1999, the Committee approved variances to the building length and side yard requirements, but refused the floor space index variance. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

(2) Consent Applications B7/99EY and B8/99EY

Re: 7 and 9 King Edward Avenue

The applicant requested the consent of the Committee of Adjustment to sever the land at 7 and 9 King Edward Avenue into three lots for detached dwellings. The applicant also requested a variance to the minimum lot frontage requirement for each proposed lot, and variances to the side yard setback requirements for both side yards on each proposed lot. On April 13, 1999, the Committee of Adjustment refused all of the consent and variance applications. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

(3) Variance Application A44/99EY

Mr. Peter Zotalis

Re: 35 Beechwood Drive

The applicant requested a variance to permit a carport in front of the house at 35 Beechwood Drive. He applied to the Committee of Adjustment for relief from the side yard setback requirement and from the restriction against accessory structures in the front yard. The Committee of Adjustment refused the application on May 11, 1999. The applicant appealed the decision to the Ontario Municipal Board.

Staff did not take a position on this application, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

(4) Variance Application A55/99EY

Mr. David Black (Timothy's Coffees of the World Inc.)

Re: 1515 Bayview Avenue

The applicants requested a variance to the restaurant parking standard in order to permit a coffee shop on the ground floor of the building at the northeast corner of Bayview Avenue and Millwood Road. On May 11, 1999, the Committee of Adjustment approved the application. The decision was appealed by several residents of Donegal Drive.

The Transportation Services Division provided the Committee of Adjustment with comments on the application, and indicated they have no objection to the proposal. Staff did not provide the Committee with a recommendation on the disposal of the application, however, and do not recommend that Council direct staff to attend the Ontario Municipal Board hearing.

Goulding Estate

(City Council on July 6, 7 and 8, 1999, adopted this Clause, without amendment.)

The East York Community Council recommends adoption of the following report (June 3, 1999) from the Commissioner of Economic Development, Culture and Tourism subject to:

(A) amending Recommendation No. 1 by deleting the word "and" before the words "the Centre" and adding the words "Ms. Cindy Anthony and those persons who indicated an interest in the Goulding Estate when the matter was discussed by the former Borough of East York in 1996"; so that such recommendation shall now read as follows:

"a Goulding Estate advisory team be established by the Culture Division with representation from Economic Development, Culture and Tourism (Parks and Recreation - East District and Policy and Development staff), in addition to East York Local Architectural Conservation Advisory Committee Panel, the East York Foundation, the Centre for Creative Ministries, Ms. Cindy Anthony, and those persons who indicated an interest in the Goulding Estate when the matter was discussed by the former Borough of East York in 1996", and;

(B) amending Recommendation No. 3 by deleting the word "and" before the word "developing" and adding the words: "submitting a funding Plan to the East York Community Council and the Budget Advisory Committee by June 2000; and", so that such recommendation shall now read as follows:

"the Goulding Estate advisory team be charged with developing a funding proposal for the Trillium Foundation and any other grant programs that it identifies; developing a phased-in restoration and rehabilitation plan for the site in cooperation with the tenant; providing input to the Capital Budget process as required; developing an operational proposal for the site's long-term use as a public facility; and submitting a funding plan to the East York Community Council and the Budget Advisory Committee by June 2000; and":

Purpose:

To provide information with regard to funding opportunities for the Goulding Estate as a Millennium project and the ultimate return of the building to the public realm.

Source of Funds:

Funding for the restoration and rehabilitation of the Goulding Estate will come from grants from external sources and the Capital Budget.

Recommendations:

It is recommended that:

(1) a Goulding Estate advisory team be established by the Culture Division with representation from Economic Development, Culture and Tourism (Parks and Recreation - East District and Policy and Development staff), in addition to East York Local Architectural Conservation Advisory Committee Panel, the East York Foundation, and the Centre for Creative Ministries;

(2) additional community partners be identified and added by the Goulding Estate advisory team as appropriate;

(3) the Goulding Estate advisory team be charged with developing a funding proposal for the Trillium Foundation and any other grant programs that it identifies; developing a phased-in restoration and rehabilitation plan for the site in cooperation with the tenant; providing input to the Capital Budget process as required; and developing an operational proposal for the site's long-term use as a public facility; and

(4) the appropriate City officials be authorized to take the necessary action to give effect thereto.

Council Reference:

At its meeting of April 28 and 29, 1999, East York Community Council requested:

(1) that the Commissioner of Economic Development, Culture and Tourism submit a report to the East York Community Council with respect to funding opportunities for the Goulding Estate as a Millennium project and the ultimate return of the building to the public realm; and

(2) the Commissioner of Economic Development, Culture and Tourism, together with interested community groups, to continue to work with the Tenants towards the restoration of the Goulding Estate.

Discussion:

The 1996 report from the then East York Commissioner of Parks, Recreation and Operations provides a cost assessment of the capital costs for the restoration and rehabilitation of the Goulding Estate. These costs, based on a detailed conversion analysis prepared by ERA Architects Inc., are estimated at $783,000.00. These cost estimates need to be assessed in relation to the work completed by the current tenant, the proposed future use of the site, and the phasing in of the restoration work, with an amount built in for escalation of costs since the estimate was prepared.

It has been suggested that the City apply for Millennium funding for the project. The restoration and rehabilitation of the facility and grounds is proposed to begin in the year 2000 and proceed over three to four years, in cooperation with the tenant. The Millennium Bureau of Canada funds community-oriented activities. The main activities must take place during the year 2000 and be complete by March 31, 2001. The Ontario 2000 program requires that projects be completed during the millennium year.

There is, however, an interesting opportunity, given the community organizations which have expressed interest in this project, to apply for funding from the Trillium Foundation's Community Grants Program. This program is intended for new and existing programs and services at the local level. Municipalities are eligible if the project is part of a community-based collaborative effort.

This project meets two of the specific goals of Trillium's program. The first is to make creative use of existing community facilities, land and other tangible resources to meet community needs. Priority is given to strategies which increase the use of under-used assets or which encourage shared or multiple use. A second goal which relates to this project is the removal of barriers to participation in all aspects of community life, including building appreciation for local art resources.

The project also meets a significant number of the criteria of the Community Grants Program. These include:

(1) specific benefits and contribution to the community;

(2) collaboration, coordination or network building with other organizations and sectors;

(3) concrete community contribution and commitment, including voluntary, financial and in-kind support; and the degree to which Trillium funds will be used to increase other financial or non-financial support;

(4) probability of financial support in the future; and

(5) degree to which the work funded will encourage long-term thinking and lasting improvements to organizations or systems.

Multi-year grants are available for up to five years for $2,000 to $75,000 per year. East York Community Council has proposed that this work begin in the year 2000 and proceed, in cooperation with the tenant, during the remaining three years of the lease.

Conclusions:

The Goulding Estate project will benefit greatly from a collaborative approach to its development. The vision established by the former East York Council suggests "a unique heritage resource within East York providing a focus for arts, culture, heritage and the environment." By bringing City staff together with community representatives from the disciplines of the arts, heritage, horticulture, and the environment, we can develop a vital facility that interacts well with the community which it serves.

Recommendations:

It is recommended that the East York Community Council:

(1) give consideration to Members' preferences outlined in Schedule 1, and recommend to City Council the appointment of Members of Council to those special purpose bodies outlined in such Schedule for a term of office expiring November 30, 2000, and until their successors are appointed, unless indicated otherwise;

(2) recommend to City Council that the Councillors previously appointed by City Council to the business improvement areas outlined in Schedule 2 remain in office until November 30, 2000, and until their successors are appointed, in accordance with the provisions of the Municipal Act; and

(3) also recommend to City Council that leave be granted for the introduction of any necessary Bills in Council to give effect thereto.

Council Reference/Background/History:

Council has directed that the nomination process for appointing Members of Council to local special purpose bodies be conducted through the Community Councils rather than the Striking Committee (Clause No. 2 of Report No. 3 of the Special Committee to Review the Final Report of the Toronto Transition Team, adopted as amended by Council on April 13, 14 and 15, 1999).

Comments:

Community Councils have been delegated the authority to nominate Councillors for appointment to program operating boards (e.g. boards of management for business improvement areas, community/recreation centres, and arenas), external organizations of local significance supported by the City through discretionary grants, and external organizations of local significance to which Council makes appointments due to legislation or invitation.

Schedule 1 contains a list of Councillors' preferences for appointments to the special purpose bodies listed therein.

Schedule 2 contains a list of Councillors who were previously appointed by City Council to local business improvement areas for a term of office expiring May 31, 1999, and until their successors are appointed. Subsequent to these appointments, the City Clerk's office was advised that, in accordance with the Municipal Act, these appointments should have been for the term of Council, and until their successors are appointed.

Conclusion:

By recommending a slate of nominees, the Community Council will implement Council's process for appointing Councillors to local special purpose bodies. By recommending that the Councillors who were previously appointed to local business improvement areas remain in office until November 30, 2000, and until their successors are appointed, the Community Council will regularize these appointments in accordance with the provisions of the Municipal Act.

Parking Concerns on Sammon Avenue

The East York Community Council recommends adoption of the following report (May 28, 1999) from the Director, Transportation Services, District 1:

Purpose:

To report to the East York Community Council on the request for a disabled parking space adjacent to 390 Sammon Avenue.

Financial Implications:

Funds to undertake the installation of the disabled parking space in the estimated amount of $500.00 are contained in the Transportation Services Division 1999 Current Budget.

Recommendations:

It is recommended that:

(1) Schedule "E" of By-law No. 34-93, entitled "To provide for disabled person parking permit holders", as amended, be further amended to implement a disabled parking space on the north side of Sammon Avenue from a point 19.0 metres east of Kimbourne Avenue to a point 24.5 metres further east;

(2) this disabled parking space be removed when Ms. Priscilla Schimpfle no longer resides at 390 Sammon Avenue; and

(3) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto including the introduction of the necessary Bill in Council.

Comments:

The Works and Emergency Services Department received a memorandum from Councillor Prue dated May 5, 1999, forwarding a copy of a letter from Ms. Priscilla Schimpfle, 390 Sammon Avenue, dated May 4, 1999, requesting a disabled parking space adjacent to her residence. A copy of Ms. Schimpfle's disabled parking permit was provided.

Sammon Avenue, between Kimbourne Avenue and Linsmore Crescent, is 7.3 metres (24.0 feet) wide and is currently regulated by "No Parking Anytime" restriction on the south side of the street. The north side is regulated by the unsigned 3 hour parking regulation. The property at 390 Sammon Avenue is located on the north side of the street.Requesting appropriate City officials to investigate and report to the East York Community Council with respect to concerns raised by residents of Donegall Drive regarding the improper storage and removal of residential and commercial waste in the laneway between Bayview Avenue and Donegall Drive.

A site investigation conducted by Transportation Services staff confirmed that the mutual right of way to 390 Sammon Avenue is 1.9 metres (6.25 feet) wide which makes it extremely difficult to drive a vehicle to the garage in the back. Typically, a minimum of 2.2 metres (7 feet) is considered an appropriate width for access. Disabled parking spaces are installed on the street for disabled residents who do not have any access to available parking on their property, in order that they can have nearby access to their vehicle. Since the property at 390 Sammon Avenue has no reasonable access to parking, Ms. Schimpfle is eligible for a disabled parking space on the street.

In accordance with the policy of the former Council of the Borough of East York regarding notification of proposed disabled spaces, the neighbouring residents will be notified by the City Clerk's Department, East York Office, that this report is being presented to the East York Community Council.

Construction of Railway Spurs

39 Industrial Street, Esandar Drive Flank

The East York Community Council recommends adoption of the following report (June 9, 1999) from the Manager, Right of Way Management, Transportation Services, District 1:

Purpose:

To report on the property owner's request to install two railway spurs within the City's right-of-way on the Esandar Drive flank of 39 Industrial Street.

Funding Sources, Financial Implications and Impact Statement:

Not applicable.

Recommendations:

It is recommended that City Council approve the construction of two railway spurs within the City's right-of-way on the Esandar Drive flank of 39 Industrial Street, subject to the respective owners, Eka Nobel Canada Inc., 39 Industrial Street, Toronto, Ontario, M4G 1Z2, and such other licensees as may be required by the City Solicitor entering into an agreement with the City of Toronto and agreeing to:

(1) indemnify the City from and against all actions, suits, claims or demands and from all loss, costs, damages, charges and expenses that may result from such permission granted;

(2) maintain the railway spurs in good and proper repair and a condition satisfactory to the Commissioner of Works and Emergency Services;

(3) not store the railway cars within 15.9 metres of the west curb line of Esandar Drive, in order to maintain visual sight lines on Esandar Drive;

(4) pay an annual rental fee, as determined by the Commissioner of Corporate Services; and

(5) accept such additional conditions as the City Solicitor or the Commissioner of Works and Emergency Services may deem necessary in the interest of the Corporation.

Comments:

Mr. I.R. Fleming, P. Eng., of Trow Consulting Engineers Ltd., 1595 Clark Boulevard, Brampton, Ontario L6T 4V1, submitted an application requesting permission to construct two railway spurs within the City's right of way on the Esandar Drive flank of 39 Industrial Street, as shown on Appendix "A" of this report.

The proposed construction of the spurs is to allow the unloading of material into the plant at 39 Industrial Street.

Conclusion:

As the railway spurs will not impact negatively on the Esandar Drive right of way, it should be permitted subject to the owners of 39 Industrial Street, entering into an agreement with the City of Toronto.

(3) that the Toronto Police Service be requested to monitor and enforce compliance with the parking restrictions described in the foregoing Recommendations Nos. (1) and (2) for the first 30 - 60 days after the implementation of such parking restrictions; and

(4) that the appropriate City officials be authorized and directed to take the necessary action to give effect to the foregoing, including the introduction of the necessary Bill in Council.

(f) Garbage Problem in Laneway between Bayview Avenue and Donegall Drive.

The East York Community Council reports having referred the following communication and petition to the Commissioner of Works and Emergency Services and the Medical Officer of Health with a request that they submit a report thereon to the East York Community Council:

(June 15, 1999) from Councillor Jane Pitfield, requesting appropriate City officials to investigate and report to the East York Community Council with respect to concerns raised by residents of Donegall Drive regarding the improper storage and removal of residential and commercial waste in the laneway between Bayview Avenue and Donegall Drive; and

(Undated) petition, signed by approximately 61 residents of Donegall Drive, outlining their concerns respecting the garbage situation in the laneway behind the businesses on Bayview Avenue and providing photographs of the subject laneway.

(g) TTC Buses on Bessborough Drive.

The East York Community Council reports having referred the following communication from Councillor Pitfield and the written brief submitted by Ms. Brown, to the Commissioner of Works and Emergency Services and the General Manager, Toronto Transit Commission, with a request that they submit a report thereon to the East York Community Council; and, further, that the General Manager, Toronto Transit Commission, include in his report comment with respect to:

(i) the feasibility of installing signal priority detection equipment; and

(ii) why the Toronto Transit Commission did not notify the Ward Councillors with respect to the routing of buses on to Bessborough Drive:
