Minutes of the Scarborough Community Council
Meeting No. 2
Wednesday, January 21, 1998.
The Scarborough Community Council met on Wednesday, January 21, 1998, in the
Meeting Hall, Scarborough Civic Centre, commencing at 9:30 a.m.
Members Present:
Councillor Lorenzo Berardinetti, Chair

2.1 Consent Applications
Scarborough Agincourt, Scarborough Malvern,
Scarborough Wexford, Scarborough City Centre,
Scarborough Highland Creek and Scarborough Bluffs
Community Council had before it a report from the Interim Functional Lead,
Planning, dated January 8, 1998, regarding the Consent applications approved by
the Commissioner, Planning and Buildings, in accordance with the authority
delegated to him by Council, and recommending that the report be received for
information.
On motion by Councillor Ashton, Community Council received the
aforementioned report.

2.2 Site Plan Control Approvals
Scarborough Agincourt, Scarborough Malvern,
Scarborough Wexford, Scarborough City Centre,
Scarborough Highland Creek and Scarborough Bluffs
Community Council had before it a report from the Interim Functional Lead,
Planning, dated January 8, 1998, advising of the Site Plan Control Applications
granted final approval by the Commissioner, Planning and Buildings, and
recommending that the report be received for information.
On a Motion by Councillor Ashton, Community Council received the aforementioned
report.
2.3 Community Council Briefings.
Mr. Barry Gutteridge, Acting Executive Director, Emergency and Protective
Services, and Interim Service Area Lead, briefed the Community Council on the
responsibilities, authority, relation to City Council and decision-making process
that Community Council may expect to follow.
Mr. Gutteridge introduced staff from the various divisions who provided an
overview of their various functions and responded to questions from the Members.
Councillor Berardinetti appointed Councillor Altobello Acting Chair and vacated
the Chair.
Councillor Berardinetti resumed the Chair.
Mr. M. A. Price, former Acting City Manager, and Interim Functional Lead, Waste
Management, provided a verbal presentation on those matters outstanding from the
former City of Scarborough Council which included:
a) Scarborough Community Complex;
b) Scarborough Theatre/Art Gallery;
c) Scarborough Children s Safety Village;
d) Rouge Alliance;
and indicated that, with Community Council s concurrence, he will report to the
next meeting to update Members on the status of these matters.
The Briefing concluded.
Councillor Ashton moved that reports on the following matters be provided to the
next meeting of Scarborough Community Council on February 18, 1997:
1. a process to review the future use of the Scarborough Civic Centre
and environs;
2. a briefing on the Scarborough budget and its integration into the
Toronto process;
3. the current organizational structure in Scarborough;
4. the best practices associated with the former Scarborough
government functions;
5. a process to recommend a service standards and by-law harmonization
review.
Councillor Moeser moved that staff report:
1. on the procedure for Site Plan and consent approvals;
2. the status of the decision to clear windrows and the response of
the Financial Advisory Board, including comments from Legal
Services.
Councillor Mahood moved:
1. that the City Clerk be requested to initiate the process necessary
to allow for the appointment of the new Committee of Adjustment and
to delegate the authority for Consents; and
2. that the former Acting City Manager, and Interim Functional Lead,
Waste Management, report to the next meeting of Community Council
with respect to:
(a) the matters raised in his briefing; viz:
Scarborough Community Complex
Scarborough Theatre/Art Gallery
Scarborough Children s Safety Village
Rouge Alliance
(b) a process for examining the future use of the Scarborough
Civic Centre as a Theatre/Art Gallery, Central Library,
Cultural Centre.
The Community Council recessed at 12:30 p.m.
The Community Council reconvened at 2:00 p.m. with the following Members being in
attendance:

Councillor Faubert moved that the Interim Functional Lead, Legal Services, be
directed to report to Community Council on the Statutory Powers and Procedures
Act, including the rules governing Fair Hearings and the list of Acts under which
Fair Hearings must be held by this Council.
Upon the question of the adoption of the foregoing motion by Councillor Ashton, it
was carried.
Upon the question of the adoption of the foregoing motion by Councillor Moeser, it
was carried.
Upon the question of the adoption of the foregoing motion by Councillor Mahood, it
was carried.
Upon the question of the adoption of the foregoing motion by Councillor Faubert,
it was carried.
2.4 Preliminary Evaluation Report No. 3
Zoning By-Law Amendment Application Z97010

Malvern Community, Scarborough Malvern
Community Council had before it a report from the Interim Functional Lead,
Planning, dated January 8, 1998 respecting Zoning By-law Amendment Application
Z97010, recommending that Community Council convene the Public Meeting for this
application in the second quarter of 1998.
Upon the motion of Councillor Balkissoon, Community Council approved the foregoing
recommendation subject to striking out the words in the second quarter of 1998"
and substituting therefor on April 1, 1998".
2.5 Preliminary Evaluation Report
Zoning By-Law Amendment Application Z97058
2351 Kennedy Road Inc., 2351 Kennedy Road
Agincourt Centre Community
Scarborough Agincourt
Community Council had before it a report from the Interim Functional Lead,
Planning, dated January 8, 1998 respecting Zoning By-law Amendment Application
Z97058, recommending that the Community Council convene a Public Meeting to
consider this application, targeted for the second quarter of 1998, subject to:
(1) the applicant submitting a Traffic Impact Study; and
(2) staff convening a Community Information Meeting to be scheduled following
submission of Item (1) above; notice for this meeting to be provided
within 120 metres (400 feet) of the subject property and to the Central
Agincourt Community Association.
Councillor Mahood moved that the report of the Interim Functional Lead, Planning
be approved, subject to requesting the Interim Functional Lead to convene a
meeting with Councillors Mahood and Shaw and the applicant, prior to the Community
information meeting, and submit a report addressing the minimum unit sizes for
commercial space, appropriate parking standard for small commercial units and
examples of where this type of development has been successfully introduced
before; and further, the issue of deliveries and their impact on the surrounding
residential area; such report to be provided to the next meeting of the Community
Council.
Upon the question of the adoption of the foregoing motion by Councillor Mahood, it
was carried.
2.6 Bell Canada Telephone Booth Advertising
Community Council had before it a communication from the City Clerk emanating from
the Urban Environment and Development Committee held on January 12, 1998,
regarding Bell Canada Telephone Booth Advertising and extending an invitation to
Members of the Community Council and all other interested parties to appear before
the February 9, 1998, meeting of the Urban Environment and Development Committee
with respect to this issue.
Councillor Tzekas moved that staff provide a background document for information
to the Urban Environment and Development Committee indicating the position taken
on this matter by the former City of Scarborough Council.
The Chair ruled that the issue of telephone booth advertising was not before
Community Council for discussion today, and that Members should simply be taking
note of the invitation extended by the Urban Environment and Development
Committee.
Councillor Tzekas challenged the ruling of the Chair.
Upon the question, shall the ruling of the Chair be upheld, the Chair was not
upheld.
Community Council continued its discussion.
Councillor Tzekas motion stood for consideration.
Councillor Shaw moved that the motion of Councillor Tzekas be amended by adding:
That such information be also provided to all Members of Scarborough
Community Council, and in addition, further information on the position
taken by the former City of Scarborough Council regarding bus shelter
advertising.
Councillor Moeser moved that the Motion of Councillor Tzekas be further amended by
adding:
That the Manager, Sign Section, be directed to attend the Urban
Environment and Development Committee meeting on February 9, 1998 , which
was not voted upon as Mr. Gutteridge advised that appropriate staff will
attend the Committee when this issue is considered.
Councillor Kelly moved that staff be requested to access the Metro files on the
issue of Telephone Booth Advertising and provide such information to Members of
Scarborough Community Council, which was noted voted upon as the motion of
Councillor Altobello carried.
Councillor Mahood moved that Scarborough Community Council take a position in
opposition to Bell Canada Telephone Booth Advertising and convey such opposition
to the Urban Environment and Development Committee, which was not voted upon as
the motion of Councillor Altobello carried.
Councillor Altobello moved that the Urban Environment and Development Committee be
requested to defer consideration of Telephone Booth Advertising and to seek
Community Council s input before they deal with this issue.
Upon the question of the adoption of the foregoing motion by Councillor Altobello,
it was carried.
Upon the question of the adoption of the foregoing motion by Councillor Tzekas, as
amended by Councillor Shaw, it was carried.
Councillor Bas Balkissoon declared his interest in the foregoing matter, in that
he is still employed by Bell Canada.

2.7 Preliminary Evaluation Report
Official Plan Amendment Application P97021

Agincourt Centre Community, Scarborough Agincourt
Community Council had before it a report from the Interim Functional Lead,
Planning, dated January 19, 1998, advising of the status of this application, and
at the request of Councillor Mahood, agreed to consider in conjunction with this
application:
a) (January 8, 1998) report of the Interim Functional Lead, Planning,
regarding Ontario Municipal Board Hearings, and
b) (January 8, 1998) report of the Interim Functional Lead, Planning,
regarding New Applications Received;
as they affect this application.
The Community Council recessed at 3:15 p.m. to meet in private session to receive
legal advice.
The Community Council met in-camera to receive legal advice.

Councillor Mahood moved:
(a) That the report from the Interim Functional Lead, Planning, dated January
8, 1998 with respect to the Ontario Municipal Board Hearings be received
for information.
(Clause No. 2f, Report No. 1)
(b) That the report from the Interim Functional Lead, Planning, dated January
8, 1998 with respect to the New Applications Received be received for
information. (Clause No. 2g, Report No. 1)
(c) That the Scarborough Community Council, having regard for the fact that
this application does not conform to the intent and purpose of the existing
Official Plan which was adopted and approved as a result of an extensive
Land Use Study previously undertaken on these lands, recommend that Council
adopt the position to refuse the subject Official Plan Amendment
Application and direct the Interim Functional Lead, Legal Services, to
represent this position at the Ontario Municipal Board.

2.8 Any Other Matters
Community Council agreed to meet in informal session, following the conclusion of
this meeting, to draw lots for Office Space within the Scarborough Civic Centre.
2.9 The Committee adjourned its meeting at approximately 4:30 p.m.
