City Council on June 8 and 9, 2010, adopted the following:

 

1.         City Council assume the services installed for Registered Plan 66M-2371 and that the City formally assume the road and road widenings within the Plan of Subdivision.

 

2.         City Council authorize Legal Services Division to release the performance guarantee with the exception of a cash settlement in the amount of $10,000.00 required for the removal of a temporary cul-de-sac on Silver Star Boulevard south of McNicoll Avenue.

 

3.         City Council direct that an assumption By-law be prepared to assume the public highways and municipal services in Subdivision Plan 66M-2371.

 

4.         City Council authorize and direct the City Solicitor to register the assumption By‑law in the Land Registry Office, at the expense of the Owner.

 

5.         City Council authorize the City Clerk and the Treasurer to sign any release or other documentation necessary to give effect thereto.

 

6.         City Council authorize the appropriate City officials to transfer ownership of the street lighting system constructed with Plan of Subdivision No. 66M-2371 to Toronto Hydro.

The purpose of this report is to obtain approval for the installation of traffic control signals at Lawrence Avenue East and Susan Street.

 

Traffic studies reveal that the existing pedestrian refuge island should be upgraded to a traffic signal to improve safety.  As a result, traffic control signals should be installed.

Summary

The purpose of this report is to advise on the need to enact a southbound designated right-turn lane and prohibit “U” turns for northbound and southbound traffic at the intersection of Morningside Avenue at Tams Road.

 

Community Council’s recommendation and City Council’s approval of the lane designation amendment and prohibited “U” turns will improve traffic operations, provide a safer environment to motorists and allow enforcement by the Toronto Police Service at the intersection of Morningside Avenue at Tams Road.

Summary

The applicant has appealed the zoning by-law amendment application for a mixed use development at 1221 Markham Road.  The applicant has also appealed Official Plan Amendment No. 71 (OPA 71 – Markham Ellesmere Revitalization Area), adopted by Toronto City Council on August 6, 2007, as it pertains to the subject site. 

 

In March, 2010 the applicant submitted revised plans to the City and Ontario Municipal Board (OMB) proposing the construction of 696 residential condominium (apartment) units in three buildings, 21 storeys in height, and 1,846m2 (19,870 sq.ft) of retail and restaurant uses. Planning staff do not support the applicant’s current proposal since it is not consistent with the Official Plan and Markham Ellesmere Revitalization Area objectives adopted by City Council to provide for vibrant mixed use development on a public road network, complete with community benefits in exchange for increased height and density.  The applicant’s proposal aims to benefit from the intensification potential presented by the Official Plan without meeting the overall design objectives of the Official Plan and without providing the necessary supporting public infrastructure and community benefits.

 

The purpose of this report is to seek Council’s direction with respect to the appeals.  The OMB has scheduled a Pre-Hearing on June 11, 2010.  To date, the full hearing has not been scheduled.

 

This report recommends that the applicant’s zoning amendment application in its current form, be opposed at the OMB for the reasons set out in this report.  This report also recommends that the City Solicitor, in consultation with the Director of Community Planning, Scarborough District, be authorized to continue discussions with the applicant to resolve the appeal if an alternative proposal is put forward by the applicant which would address the concerns and issues raised in this report, to the satisfaction of the City.

2.         City Council authorize City staff to support amendments to the Employment District Zoning By-law No. 24982 (Milliken Employment District) for the lands at 3241-3261 Kennedy Road and 19-27 Passmore Avenue, subject to the following conditions:

 

a.         the additional small scale retail and service uses be restricted to those generally outlined in Attachment 5 to the report (May 5, 2010) from the Director, Community Planning, Scarborough District: Recommended List of Additional Uses;

 

b.         the size of any individual small scale retail and service uses be capped as generally shown in Attachment 5 to the report (May 5, 2010) from the Director, Community Planning, Scarborough District: Recommended List of Additional Uses;

 

c.         the small scale retail and service uses, including restaurants be restricted to a maximum of 30% of the gross floor area of all buildings or 5 240 square metres (56,405 square feet);

 

d.         maximum gross floor area of all restaurant uses be restricted to 1 466 square metres (15,780 square feet) or 8 percent of the gross floor area of all buildings; and,

 

e.         minimum of 366 parking spaces be provided.

 

3.         City Council authorize the City Solicitor to request the OMB to withhold its Order approving the zoning by-law amendment until a draft by-law is prepared to the satisfaction of the City Solicitor in consultation with the Chief Planner and Executive Director of the City Planning Division.

The purpose of this report is to inform City Council of the status of the subject zoning by-law amendment application and to seek direction from Council for an upcoming Ontario Municipal Board (OMB) Hearing on appeal by the owner.  This report recommends that the City Solicitor and appropriate staff attend the OMB and bring forward the position outlined in this report to the Hearing scheduled for June 15, 2010.

Summary

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

The zoning by-law amendment application seeks a revision to a previously approved residential development to provide flexibility to the current zoning by permitting rear lane townhouses.  This application to amend the zoning by-law proposes to permit the redevelopment of the property at 300 Danforth Road with approximately 258 to 281 dwelling units in a variety of housing forms, such as stacked townhouses, rear lane townhouses, street townhouses and semi-detached units.  The current density which provides for a total of 348 dwelling units will remain unchanged.

 

The proposed land use is consistent with the Mixed Use Area and Neighbourhood policies of the City’s Official Plan.  The proposal implements objectives of the Warden Woods Community Secondary Plan.  The zoning by-law amendment will allow for the appropriate development of the site, compatible with the surrounding development.

 

This report reviews and recommends approval of the application to amend the zoning by-law.

Committee Recommendations

Scarborough Community Council recommends that:

 

1.         City Council amend the Sullivan Community Zoning By-law No. 10717, for the lands at 2969 Sheppard Avenue East  substantially in accordance with the draft zoning by-law amendment attached as Attachment 4 to the report (May 5, 2010) from the Director, Community Planning, Scarborough District.

 

2.         City Council amend the Scarborough Site Plan Control By-law No. 21319 substantially in accordance with the draft site plan control by-law attached as Attachment 5 to the report (May 5, 2010) from the Director, Community Planning, Scarborough District.

 

3.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft zoning by-law amendment and draft site plan control by-law as may be required.

Summary

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes to allow an office use to operate from within an existing house-form building located at 2969 Sheppard Avenue East on a permanent basis. The office use was previously permitted for a  temporary,  three year period only.

 

This report reviews and recommends approval of the application to amend the zoning by-law.

City Council Decision

City Council on June 8 and 9, 2010, adopted the following:

 

1.         City Council, for liquor licensing purposes, advise the Alcohol and Gaming Commission of Ontario that it has no objection to the following requests for:

 

a.         the issuance of an extension of the existing license to allow for an outside beer garden for the Royal Canadian Legion Annual Parade and Military Tattoo to be held on August 15, 2010, from 11:00 a.m. to 10:00 p.m. at the Royal Canadian Legion Centennial Branch 614, 100 Salome Drive;

 

b.         the issuance of a liquor licence for the 42nd anniversary of the West Indies United Sports Club (Toronto) Inc., to be held on Friday, July 30, 2010, from 7:30 p.m. until 1:00 a.m., at the Everest Banquet Hall, 1199 Kennedy Road, Scarborough;

 

c.         the issuance of an extension of the existing license to allow for an outside beer garden at the rear portion of the parking lot at Royal Canadian Legion Oakridge Branch 73 at 2 Robinson Avenue for the following:

 

Canada Day Community Barbeque to be held on July 1, 2010, from 12:00 p.m. to 9:00 p.m.;

Civic Holiday Community Barbeque to be held on August 2, 2010, from 12:00 p.m. to 9:00 p.m.

Warriors Day Community Barbeque to be held on August 21, 2010, from 12:00 p.m. to 9:00 p.m.

Labour Day Community Barbeque to be held on September 6, 2010, from 12:00 p.m. to 9:00 p.m.
