Summary
The purpose of this report is to recommend modifications to the appointments process for members of the Administrative Penalty Tribunal.
Recommendations
The City Clerk recommends that the Tribunals Nominating Panel recommend to City Council that:
1. City Council modify the appointment process for the Administrative Penalty Tribunal to authorize Court Services staff and the City Clerk to shortlist, interview and recommend candidates to the Tribunals Nominating Panel for appointment by City Council, including addressing any vacancies as they arise.

The Administrative Penalty
Tribunal is a large recruitment with 25 public members including Chair
The Chair and public members are to be recruited in accordance with the City's Public Appointments Policy. The Tribunals Nominating Panel would review applications and shortlist, interview and recommend candidates to City Council for appointment.
To complete the selection process within the required timeline, Public Appointments staff have identified that the Nominating Panel will need to commit five full days which would include the review of 462 applications, shortlisting of candidates, conducting up to 60 interviews and final deliberations. This is a large time commitment for the Panel members given that they are also currently involved in the selection process for three other tribunals with a deadline of May 2017.
The Administrative Penalty
Tribunal positions are administrative with limited authority
Court Services staff have identified that the positions have limited authority under the by-law, therefore it is more appropriate for staff to undertake recruitment functions and propose candidates to the Nominating Panel for their consideration.

This report proposes that City Council modify the appointment process to authorize Court Services staff and the City Clerk to shortlist, interview and recommend candidates to the Nominating Panel. City Council will consider the Panel's recommendations and appoint the Chair and the public members.
To be consistent with the modified appointment process and to be more conducive to managing vacancies, Court Services staff and the City Clerk will address vacancies as they arise and will report to the Nominating Panel as required.
