Two development applications have been submitted by Top of the Tree Developments Inc. on lands in the area north of Eglinton Avenue and west of Yonge Street as indicated on the Context Plan.
The area under application for Official Plan Amendment is outlined by the dashed line in the Context Plan and the red line on the aerial photograph. The area of application for Zoning By-law Amendment is the hatched parcel on the north side of Montgomery Avenue on the context plan and the yellow line on the aerial photograph.

Staff Refusal Report
On Tuesday, April 8, 2008, starting at 11:45am, North York Community Council will consider a staff report recommending the refusal of the Official Plan Amendment and Zoning By-law Amendment Applications. A copy of the staff report can also be found as Item NY 14.58 on the April 8 agenda. North York Community Council meets at the North York Civic Centre on the Lower Level in the Council Chamber.
Printed copies of the staff report or any communications on the staff report are available from the City Clerk's Office on the Ground Floor of the North York Civic Centre at 5100 Yonge Street. Information can be mailed out by City staff to interested individuals upon request. The Community Council's email address is nycc@toronto.ca.
Individuals wishing to make a presentation or comment on Item NY14.58 at the April 8 meeting of North York Community Council should phone 416-395-0480 or email nycc@toronto.ca by noon the day before the meeting to insure inclusion on a list of speakers prepared in advance by the City Clerk's Office. Presentations are limited to five minutes in length so that everyone who wishes to speak is afforded the opportunity to do so.

Application to Amend the City of Toronto Official Plan
On August 1, 2007 an application was submitted by Top of the Tree Developments to amend the City of Toronto Official Plan. The application encompasses the lands bounded by Roselawn Avenue to the north, Duplex Avenue to the west, Helendale Avenue to the south and the rear lot lines of the Yonge Street properties between Roselawn and Helendale. These lands fall within the Yonge-Eglinton Secondary Plan Area.
The application seeks to change the designation of the lands from "Neighbourhoods" to "Apartment Neighbourhoods". The image to the right shows the land use designations in the City of Toronto Official Plan.
"Neighbourhoods" are considered physically stable areas made up of residential uses in lower scale buildings such as detached houses, semi-detached houses, duplexes, triplexes and townhouses as well as interspersed walk-up apartments that are no higher than four storeys. The requested re-designation to "Apartment Neighbourhoods" would permit a greater scale of apartment development with different scale-related criteria to guide development. "Apartment Neighbourhoods" are made up of apartment buildings and parks, local institutions and recreational facilities as well as all uses provided for in the "Neighbourhoods" designation.
Application to Amend the Zoning By-law for the Former City of Toronto
On December 13, 2007, Top of the Tree Development submitted a rezoning application for the lands on the north side of Montgomery Avenue at Duplex Avenue (hatched area on the above context plan). The materials submitted in support of the application indicate the development is consistent with the redesignation proposed by their Official Plan Amendment.
The subject lands are zoned R2 Z1.0 by the Zoning By-law of the Former City of Toronto which permits a wide range of residential uses including detached dwellings, semi detached dwellings and apartment buildings. The maximum density permitted is 1.0 times the area of the lot and the maximum permitted height is 9.0 meters.
The rezoning application proposes an apartment building of 25 storeys in height on the eastern edge of the site, which terraces down to 18, 9, and eventually 3 storeys as at Duplex Avenue. The proposed apartment building would contain over 300 units and have a density of 8.95 times the area of the lot. Additional site statistics can be found on the project's application data sheet.
