Compliance Audit Process
To request a compliance audit of a candidate who may have violated the campaign finance rules of the Municipal Elections Act, 1996 as amended (MEA), you must:
- be an eligible to vote in the City of Toronto municipal election
- have reasonable grounds that campaign finance rules have been broken
- fill in and submit an application form
City Council has established a Compliance Audit Committee to consider applications for the 2014-2018 Council Term, including by-elections. Find out more information about Compliance Audit Committee meetings.
To file an application for a compliance audit of a candidate’s election campaign finances, an elector is required to complete the application and provide reasons.
An application for mayor or councillor candidate must be filed with the City Clerk at:
City Clerk’s Office, Election Services
City Hall, 1st Floor North
100 Queen St. W.
Toronto, ON M5H 2N2
An application for a school board trustee candidate must be filed with the Director of the applicable school board.
The Municipal Elections Act, 1996 as amended (MEA) provides that the application must be made within 90 days after the latest of:
- the primary filing date
- and if applicable, the supplementary filing date
Candidates may apply to the Superior Court of Justice to extend the date the financial statement is due. In addition, the MEA provides candidates with a 30 day grace period in which to file a financial statement if a $500 late filing fee is paid. In either of these scenarios, the 90 day compliance audit period starts from the day the candidate files the financial statement.
