How to file comments/materials
Full copies of all application files that are scheduled for hearing are sent to the Committee Members by noon every Friday prior to the public hearing day.
To ensure that the members have ample time to consider your concerns/comments/information, please consider submitting your materials/letters/photographs prior to the members receiving their Agenda packages.
Email your correspondence in PDF format to the assigned Committee of Adjustment Case Manager.
Sending your comments by the filing date will ensure that the Committee members have sufficient time to consider your views prior to conducting site inspections and prior to the hearing. In addition, your correspondence will form part of the public record.
Please focus your comments on the matters listed in the Notice of Public Hearing (i.e. issues related to noise, property maintenance and construction concerns are not matters for consideration by the Committee).
Complete applications and hearing schedules
Applications that have been deemed complete by the Committee will be scheduled first. A complete application means that the application contains the required materials and is in a form that the applicant/agent is prepared to defend at the Public Hearing and that the Committee can make a decision on, one way or the other.
Applications that are not complete will not be given a hearing date and will be marked postponed until such time that the Applicant can confirm in writing that they are prepared to proceed to a hearing for a decision.
Revising proposal after it has been accepted
Any revisions to an application received by both Customer Service and/or the Committee of Adjustment must be submitted to the Committee of Adjustment Case Manager not less than 30 business days prior to the tentative hearing date. Revising an application after it has been accepted may result in an application being postponed and moved to a later hearing date.
Deferrals are awarded at the discretion of the Committee members and are not automatic
You are encouraged to consult with your neighbours and City staff prior to filing your application and/or well in advance of the issuance of the Notice of Public Hearing. Doing so improves our ability to administer the process in a fair and timely manner.
Public hearing supporting evidence and presentation materials
Deadline to file is no later than 3 p.m. every Thursday before the scheduled public hearing.
Email your documents to your Case Manager in PDF format by the filing date(s) listed below.
Please check and monitor the Application Information Centre to see if your hearing date has changed and check for materials on file.
As of July 1, 2016, changes to the Planning Act prohibit an applicant from making an application for a minor variance if a site-specific zoning by-law has been passed within the last two years.
If your property has been the subject of a site-specific by-law passed within the last two years then you will need Council approval to proceed with the application. Please contact Community Planning for information on how to proceed with the application.
If your property has not been the subject of a site-specific zoning by-law passed within the last two years then you can make an application.
The agenda or decision may contain information that you have difficulty viewing, such as maps and tables. If you have difficulty viewing these documents or you require a more detailed explanation, please contact the Committee of Adjustment at 416-392-7565.
