Subject: Food and Beverages in Recreational Uses in Scarborough's Employment Areas

Purpose:

To respond to Community Council's March 30, 1999 request for clarification of current practices with respect to food and beverage activities in recreational uses in employment areas and associated applications for Occasional Use Liquor permits.

Background:

At its meeting on March 30, 1999, Community Council identified an issue with respect to the issuance, by the Liquor Licensing Board (LLBO), of Occasional Use permits for social functions in Recreational Uses in Scarborough's Employment Districts. Community Council requested a report outlining the City's current practices.

Comments:

The City does not normally become involved in the issue of applications for Occasional Use Liquor permits. The City only becomes involved when it becomes aware of associated problems with such permits. This occurs when the City has received complaints or cautions with respect to such applications at a specific address, such as excessive noise or parking overflows.

In these instances the Municipal Standards Division will advise the LLBO of any relevant complaints history on the property and will ask the Building Division for a Zoning interpretation with respect to the appropriateness of the proposed activity.

Social clubs serving food and drink are considered as banquet halls/restaurants and would have to be zoned as such. Food and beverage activities which are considered to be incidental to recreational uses, ie. lounges in pools halls, are considered to be allowable. These situations are reviewed by Zoning on a site by site basis. If approval is granted by the Zoning Section it is limited to a maximum area deemed to be incidental to the recreational use.

The results of the Zoning examination are forwarded to the LLBO by the Municipal Standards Division. Normally, if the City advises the LLBO that the permit applied for would be in contravention of the Zoning By-law, the LLBO denies the permit.
