Purpose:

To advise Community Council of the status of discussions between the applicant and the community on outstanding issues of the application.

Financial Implications and Impact Statement:

None.

Recommendations:

It is recommended that Scarborough Community Council defer the recommendations contained in the June 4, 1999, staff report, sine die, until the applicant requests that the matter be brought back for consideration.

Background:

At its October 12, 1999, meeting, Scarborough Community Council deferred the recommendations contained in the June 4, 1999, staff report, to the November 9, 1999 Scarborough Community Council meeting, to allow the parties more time to resolve outstanding issues. The applicant has advised that they have communicated several times with the residents and have exchanged proposals and counter-proposals. They are still waiting for a reply from the residents with respect to the side yard issue.

Comments:

The outstanding issue is whether a 7.5 metre (25-foot) side yard set back is sufficient to accommodate the proposed building which is to be located close to Kingston Road. Traditionally, the zoning requirement for side yard setbacks for multiple-family dwellings has been established as the distance equivalent to half the height of the building. Assuming a building height of 9.8 to 10.7 metres (32 to 35 feet) for the proposed building, the required side yard set back would be 4.9 to 5.3 metres (16 to 17.5 feet). In staff's opinion, a 7.5 metre (25-foot) side yard setback would be adequate in this case.

Given the delay in resolving this matter, Council should defer the matter sine die until the applicant requests that it be brought back for consideration.
