The Scarborough Community Council recommends the adoption of the following report
(February 4, 1999) from the City Solicitor:
Purpose:
The Legal Division is requesting Council authority to retain outside planning evidence.
Funding Sources, Financial Implications and Impact Statement:
A maximum of $15,000.00 to be allocated from the Corporate Contingency Account for the
retention of an outside planning witness.
Recommendations:
It is recommended that a maximum of $15,000.00 be allocated to the Legal Division from a
Corporate Contingency Account to retain a planning witness with respect to the pending
Ontario Municipal Board appeal on 5039 Finch Avenue and 2627 McCowan Road.
Council Reference/Background/History:
The landowner appealed to the Ontario Municipal Board from the refusal of the Council to
enact a proposed amendment to its Official Plan and Zoning By-law to permit an increase in
density from 470 to 616 residential dwelling units or by 146 dwelling units, and to reduce the
indoor recreation floor space requirement from a minimum of 3 square metre (32.2 square
feet) to 1.5 square metres (16square feet) per dwelling unit, for the phased development at the
southeast corner of Finch Avenue and McCowan Road.
Since planning staff are unable to provide evidence under oath, we require a planning
consultant to support the Decision of the Council.
