Ward 16 - Scarborough Highland Creek

The Scarborough Community Council recommends that City Council:

(1)appeal the April 21, 1999, decision of the Committee of Adjustment (Scarborough) respecting Variance Application SA100/99, Midov Developments Ltd., 325 Morrish Road; and

(2)authorize the City Solicitor to retain outside planning expertise to defend the City position, at a cost not to exceed $10,000.00.

The Scarborough Community Council reports, for the information of City Council, having requested that the Director of Community Planning, East District, report to the next meeting of Scarborough Community Council respecting the Consent application by Midov Developments Ltd.

The Scarborough Community Council submits the following communication (April 26, 1999) from Councillor Ron Moeser:

On behalf of the residents of the Highland Creek Community, I would hereby request Council to support an appeal of the April 21, 1999 decision of the Committee of Adjustment.

The lot frontage is not in keeping with the character of the area. The zoning by-law permits a lot frontage of 15.2 feet whereas the application proposal was to permit a frontage of 12.27 metres.

I would also request Council to hire outside planning expertise to defend its position.
