Construction of a Fence and Arbour - Evelyn Crescent

The Toronto Community Council recommends the adoption of the following report (April7,1999) from the
Manager, Right of Way Management, Transportation Services, District 1:
Purpose:
To report on the homeowner's request to construct a 2.1 m high fence and arbour within the public right-of-way which
exceeds the maximum height of 1.9 m permitted under Municipal Code Chapter 313, Streets and Sidewalks, of the former
City of Toronto Municipal Code. As this is a request for a variance from the by-law, it is scheduled as a deputation item.
Funding Sources, Financial Implications and Impact Statement:
Not applicable.
Recommendation:
That City Council approve the construction of a wooden fence and arbour within the public right-of-way on the Evelyn
Cresent flank of 124 Evelyn Avenue, subject to the owner entering into an agreement with the City of Toronto, as
prescribed under Chapter 313 of the former City of Toronto Municipal Code.
Comments:
Ms. Margaret Wong, owner of 124 Evelyn Avenue, Toronto, Ontario M6P 2Z5, submitted an application dated November
25, 1998, requesting permission to construct a wooden fence and arbour within the public right-of-way on the Evelyn
Cresent flank of 124 Evelyn Avenue.
The fence ranges in height from 1.5 m to 2.1 m which exceeds the maximum height of 1.9 m permitted in Chapter 313 of
the former City of Toronto Municipal Code.
Staff have inspected the area in the immediate vicinity of this property and determined that this fence would be consistent
with the streetscape as there are other fences of similar height in the area.
A letter signed by 5 property owners in support of this proposal is on file with this Department.
Conclusion:
As this fence and arbour do not impact negatively on the public right-of- way, the construction of the fence and arbour
should be permitted.
