The Scarborough Community Council recommends the adoption of the
following report (December 7, 1999) from the Director of Community
Planning, East District:
Purpose:

Peter Pitino is proposing to
construct a residential development
consisting of one single-family
dwelling (Part 17), two semi-detached dwellings (Parts 13-16)
and eleven street townhouse
dwellings (Parts 1-11) at the south-west corner of Kingston Road and
Brinloor Boulevard (Figure 2). This
application requests lifting Part Lot
Control on the land to permit the
creation of sixteen separate
residential lots and one parcel to be
dedicated to the City for corner
rounding (Part 12).
Recommendation:
It is recommended that:
(1) City Council enact a Part Lot Control Exemption By-law with
respect to Block B and Part of Block C, Registered Plan 4235;
(2) the Part Lot Control Exemption By-law be repealed one (1) year
from the date of the passing of the By-law;
(3) all conveyances which occur after the exemption from Part Lot
Control shall be in accordance with Reference Plan(s) to be
approved by the Director of Community Planning East District,
prior to the plan(s) being deposited in the Land Registry Office;
and
(4) City Council authorize any unsubstantive technical, stylistic or
format changes to the Exemption By-law as may be required to
give effect to this resolution.
Background:
The land is designated Medium Density Residential (RM) in the Official Plan
and is zoned Multiple-Family Residential (M), permitting single-family, semi-detached and street townhouse dwellings. The proposed lotting on Figure 2
conforms to the Official Plan and Zoning By-law.
Comments:
Section 50(7) of the Planning Act, 1990, authorizes the lifting of Part Lot
Control on lots or blocks within a registered plan. This method of land
division allows lot lines to be finalized during or after construction and
is advantageous, especially for street townhouses, because it avoids the
potential problem of party walls of dwelling units not coinciding exactly
with lot lines.
The preparation of reference plans for the proposed lot divisions,
reviewed by the Director of Community Planning prior to registration on
title, will ensure municipal monitoring and control and will ensure that
the deposited plans reflect Councils approval. There are no Official Plan or Zoning
concerns raised by this application.
The application was circulated to reporting Departments and Agencies. No comments or
concerns have been raised.
Conclusions:
The lifting of Part Lot Control on the subject lands will facilitate the finalization of a successful
residential development previously endorsed by the Toronto City Council.
