The Scarborough Community Council recommends the adoption of the
following report (December 22, 1999) from the Director of Community
Planning, East District:
Purpose:

Intracorp Developments Ltd.
wishes to commence
construction of the development
located east of Port Union Road
south of Shoalhaven Drive. The
development will consist of street
townhouses and two detached
units to be constructed in the
future. This application seeks
approval to lift Part Lot Control
for the 31 street townhouse uinits,
thereby allowing for the
registration of easements for
services, maintenance and minor
encroachments.
Financial Implications and Impact
Statement:
None.
Recommendations:
It is recommended that City Council:
(1) enact a Part Lot Control Exemption By-law with respect to Block
163, Registered Plan 66M-2313; and
(2) deem that the Part Lot Control exemption By-law shall expire one
(1) year from the date of passing the By-law.
Background:
The subject lands are designated Medium Density Residential (RM) in
the Official Plan. The lands are zoned "A(H)" Apartment Residential and
"M(H)" Multiple-Family Residential permitting a maximum of 73 dwelling
units prior to the removal of the (H) Holding Symbol and a maximum of
101 dwelling units upon removal of the (H) Holding Symbol. The
proposed lotting shown on the approved site plan conforms to the
Official Plan and Zoning By-law. Section 50(7) of the Planning Act, 1990,
authorizes Council to adopt a By-law exempting lands within a required
plan of subdivision from part lot control. The townhouse lots will be
established to create individual parcels on the reference plan, however,
in some instances parts of roof structures such as eaves and soffits
from one unit will encroach upon the adjacent parcel. As such
easements will be necessary to provide access for maintenance
purposes between adjacent buildings. Easements will also be required
to provide for the servicing of this development.
Conclusions:
The lifting of Part Lot Control on the subject property will facilitate the
implementation of easements and encroachments allowing for the
development to proceed as endorsed by the former Scarborough
Council.
