Minutes of the Meeting of The North York Community Council
Wednesday, January 21, 1998.
The North York Community Council met on Wednesday, January 21, 1998, in the Council
Chamber, North York Civic Centre, commencing at 9:30 a.m.
Members Present:

2. Community Council Briefing.
The North York Community Council received presentations from the following City officials:
- Ms. Wanda Liczyk, Chief Financial Officer and Treasurer; and
- Mr. George Dixon, Solicitor, North York Civic Centre.
A. Councillor Moscoe, North York Spadina, moved that:
(i) the Functional Lead for Legal Services be requested to review the
Procedural By-law as it relates to the requirements of the Statutory Powers
and Procedures Act and the Planning Act; and
(ii) the Functional Lead for Planning be requested, as a matter of policy, to
consult with the respective Councillors of the affected Wards prior to a
report being brought forward to Council and prior to any site plan matter
being approved.
B. Councillor Mammoliti, North York Humber, moved that the Special Committee to
Review the Final Report of the Transition Team and Council consider amending the
Council Procedural By-law to provide for a 60 percent majority vote to be required
at City Council to overturn a Community Council decision.
C. Councillor Gardner, North York Centre, moved that the Special Committee to Review
the Final Report of the Transition Team and Council consider authorizing Community
Councils to be able to establish special committees or working groups only on
those matters that are within the jurisdiction of Community Councils.
Mr. Joe Halstead, Functional Lead for Parks and Recreation, continued with the briefings.
D. Councillor King, Seneca Heights, moved that the issue of Community Council
responsibilities for the Parks and Recreation Department and its ability to deal
with the financing of those responsibilities be referred to the Special Committee
to Review the Final Report of the Transition Team and Council for consideration.
E. Councillor Mammoliti, North York Humber, moved that the Functional Lead for Parks
and Recreation be requested to submit a report to the next meeting of the North
York Community Council scheduled to be held on February 18, 1998 with
recommendations on the proposed St. Basil s Agreement.
The North York Community Council recessed at 12:31 p.m. and reconvened at 2:12 p.m. in the
Council Chamber, North York Civic Centre.

F. Councillor Mammoliti, North York Humber, moved that the Special Committee to
Review the Final Report of the Transition Team and Council consider the advantage
and disadvantages of changing the committee structure to allow the By-Law
Enforcement Section to report to the Emergency and Protective Services Committee
as opposed to the Urban Environment and Development Committee.
G. Councillor Minnan-Wong, Don Parkway, moved that the Special Committee to Review
the Final Report of the Transition Team and Council be advised that the North York
Community Council is opposed to any centralization of By-law Enforcement if it
will lead to service delivery cuts to the residents of North York.
Mr. Alan Wolfe, Commissioner of Public Works, North York Civic Centre, continued with the
briefing.
H. Councillor Filion, North York Centre, moved that the Special Committee to review
the Final Report of the Transition Team and Council consider permitting recorded
votes at Community Council meetings.
I. Councillor Chong, Don Parkway, moved that the Special Committee to review the
Final Report of the Transition Team and Council consider permitting recorded votes
at all Standing Committee meetings.
J. Councillor Moscoe, North York Spadina, moved in amendment to the motion moved by
Councillor Filion, North York Centre, that recorded votes be permitted at
Community Council meetings only as they relate to planning matters; and in the
interim, North York staff be directed to take recorded votes on planning issues,
on the request of any member of the Community Council, until such time as the
Council Procedural By-law is amended.
Upon the question of the adoption of Part (i) of motion A. moved by Councillor
Moscoe, North York Spadina, it was carried.

The following is a summary of the action taken by the North York Community Council:
The North York Community Council reports having:
(1) recommended to the Special Committee to Review the Final Report of the Transition
Team and Council that:
(a) the Council Procedural By-law be amended as follows:
(i) a 60 percent majority vote be required at City Council to overturn
a Community Council decision;
(ii) Community Councils be authorized to establish special committees or

3. Preliminary Evaluation Report - Official Plan and Zoning Amendment Application UDOZ-97-44 -
Tridel Builders Inc. - 1857 Leslie Street - Ward 11 - Don Parkway
The North York Community Council had before it a report (January 7, 1998) from the Acting
Commissioner of Planning respecting an application to amend the Official Plan and Zoning
By-law to permit two 32-storey residential buildings, a one storey recreational amenity
facility and a one storey rental commercial building at 1857 Leslie Street (Schedule A);
advising that the proposed gross floor area is 84,500 square metres, representing a
density of 2.7 floor space index; and recommending that:
(1) the Planning Department schedule a community consultation meeting in consultation
with the local Councillors;
(2) staff be directed to prepare a Principle of Land Use report evaluating the
appropriateness of the change in land use from industrial to mixed use; and
(3) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.
On a motion moved by Councillor Flint, North York Centre, the North York
Community Council approved the foregoing report.

4. North York Building Permit - Statistics - November 30, 1997 and December 31, 1997.
The North York Community Council had before it reports (December 1, 1997 and January 7,
1998) from the Building Commissioner forwarding summaries of construction activity in
North York for the months of November and December 1997.
On a motion moved by Councillor Gardner, North York Centre, the North York
Community Council received the foregoing reports.

5. Municipal Servicing for Zoning Amendment Application - UDOZ-95-31 - Royal Mansions Inc. -
Ghods Builders -Ward 10 - North York Centre
The North York Community Council had before it a report (January 8, 1998) from the
Commissioner of Public Works requesting authorization to construct the necessary municipal
services for zoning amendment application UDOZ-95-31, Royal Mansions Inc., development
site and to allocate the necessary monies from the City's Yonge Centre Development Charges
Fund and the developer s deposited funds.
On a motion moved by Councillor Moscoe, North York Spadina, the North York
Community Council approved the foregoing report.

6. Municipal Servicing For Zoning Amendment Applications - UDOZ-95-13 and UDOZ-92-54 -
Northtown Site - Eminent Construction Inc. - Ward 10 - North York Centre.
The North York Community Council had before it a report (January 5, 1998) from the
Commissioner of Public Works requesting authorization to construct the necessary municipal
services for zoning amendment applications UDOZ-95-13 and UDOZ-92-54 at the Northtown
Development site and to allocate the necessary monies from the Yonge Centre Development
Charges Fund.
On a motion moved by Councillor Gardner, North York Centre, the North York
Community Council approved the foregoing report.

7. Funding For Study of the North York Bridle Path - Post Road Drainage System - Ward 9 -
North York Centre South.
The North York Community Council had before it a report (January 14, 1998) from the
Commissioner of Public Works requesting funding authorization for a study of an innovative
drainage system installed in the Bridle Path - Post Road area as part of the 1997 road
reconstruction program with the funding to be provided from the Water Rate - Sewer and
Erosion Capital Account and recommending that:
(1) the City s portion of funding a monitoring study of the Bridle Path - Post Road
drainage system in the amount of $50,000.00 be financed from the Sewer and Erosion
Capital Account (no 1998 operating budget impact);
(2) the Great Lakes 2000 Cleanup Fund and the Ministry of Environment in charge of the
Storm Water Assessment Monitoring and Performance Program (SWAMP) be notified;
(3) upon completion of the study, a further report be submitted with the findings and
recommendations; and
(4) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.
On a motion moved by Councillor Moscoe, North York Spadina, the North York
Community Council approved the foregoing report.

8. Preliminary Evaluation Report - Official Plan and Zoning Amendment Application UDOZ-97-48
- Har-Ru Holdings Limited - 1 Canyon Avenue - Ward 9 - North York Centre South.
The North York Community Council had before it a report (January 6, 1998) from the Acting
Commissioner of Planning reporting on an application to amend the Official Plan and
Zoning By-law to permit a new 11 storey condominium apartment building to the east of the
existing 17 storey rental apartment building on the north side of Sheppard Avenue West,
east of Bathurst Street, and recommending that:
(1) the Planning Department schedule a community consultation meeting in consultation
with the local Councillors;
(2) the applicant be requested to submit a slope stability study, a soil contamination
phase 1 audit and other further studies as required; and
(3) staff be directed to prepare a Recommendations Repot on the application and
provide notice of the statutory public meeting at the appropriate time.
Councillor Moscoe, North York Spadina, moved that the slope stability study
referred to in Recommendation No. (2) of the foregoing report be received
and reviewed by the North York Community Council prior to any action being
taken on Recommendations (1) and (3).
Upon the question of the adoption of the foregoing motion by Councillor Moscoe, it

Due to a lack of quorum, the North York Community Council recessed at 4:17 p.m., and
reconvened at 4:34 p.m., in the Council Chamber, North York Civic Centre.

9. Preliminary Evaluation Report - Zoning Amendment Application UDOZ-97-47 Panos Komitas -
119 Steeles Avenue East - Ward 10 - North York Centre.
The North York Community Council had before it a report (January 6, 1998) from the Acting
Commissioner of Planning reporting on an application to amend the Zoning By-law to permit
the construction of a two storey semi-detached dwelling (two units), and recommending
that:
(1) given the scale and size of the rezoning, community consultation be obtained at
the statutory public meeting;
(2) staff be directed to prepare a Recommendations Report on the application and
provide notice of the statutory public meeting at the appropriate time; and
(3) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.
Councillor Filion, North York Centre, moved that:
(1) the foregoing report be approved with the exception of Recommendation
No. (1);
(2) requested the local Councillors to carry out the community consultation
prior to the publication of a report by the Functional Lead for Planning;
and
(3) directed that notice of a statutory public meeting be given only after the
Community Council has received a report on this application from the Acting
Commissioner of Planning.
On a motion by Councillor Filion, North York Centre, it was carried.

10. Preliminary Evaluation Report - Official Plan and Zoning Amendment Application UDOZ-97-45 -
505000 N.B. Inc. - 2800 Bathurst Street - Ward 8 - North York Spadina.
The North York Community Council had before it a report (January 7, 1998) from the Acting
Commissioner of Planning reporting on an application to amend the Official Plan and
Zoning By-law to permit a 9 storey, 126 unit apartment hotel with a restaurant, and
recommending that:
(1) the Planning Department Schedule a community consultation meeting in consultation
with the local Councillors;
(2) the applicant submit a parking study and a contamination phase one and two audit
of the site;
(3) staff be directed to prepare a Recommendations Report on the application and
provide notice of the statutory public meeting at the appropriate time; and
(4) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.
Councillor Moscoe moved that:
(1) consideration of Recommendations Nos. (1) and (3), embodied in the
foregoing report be deferred, pending an informal community consultation
meeting being held by the local Councillors;
(2) the applicant be advised that the application is excessive;
(3) the applicant to submit a parking study and contamination phase one and two
audit of the site; and
(4) requested the Functional Lead for Transportation to carry out a preliminary
evaluation of the proposal prior to the formal community consultation.
On a motion by Councillor Moscoe, North York Spadina, it was carried.

11. Preliminary Evaluation Report - Official Plan and Zoning Amendment Application UDOZ-97-46 -
Clairtrell Road Development Limited - 6, 9, 10, 11, 12, 16-23 Clairtrell Road - Ward 10 -
North York Centre.
The North York Community Council had before it a report (January 6, 1998) from the Acting
Commissioner of Planning reporting on an application to amend the Official Plan and Zoning
By-law to permit two, 10 storey apartment buildings with 236 residential units and 76
stacked townhouse dwelling units on both sides of Clairtrell Road, north of Sheppard
Avenue East, west of Bayview Avenue, and recommending that:
(1) the Planning Department schedule a community consultation meeting in consultation
with the local Councillors;
(2) staff be directed to prepare a Principles of Development Report to evaluate this
application in the context of the Official Plan Amendment 392 and the private
appeals of this application against Official Plan Amendment 392. (This should be
settled prior to the scheduling of a statutory public meeting to consider this
application); and
(3) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.
Councillor Filion, North York Centre, moved that the foregoing report be approved
subject to Recommendation No. (2) being amended to read as follows:
"(2) staff be directed to prepare a Principles of Development Report to
evaluate this application in the context of the Official Plan
Amendment 392."
On a motion by Councillor Filion, North York Centre, it was carried.

12. Preliminary Evaluation Report - Official Plan and Temporary Use Zoning Amendment
Application UD52-97-03 - 1190082 Ontario Limited - 22 Old York Mills Road - Ward 9 - North
York Centre South.
The North York Community Council had before it a report (January 8, 1998) from the Acting
Commissioner of Planning respecting on an application to amend the Zoning By-law to
permit the continued use of a 112-space parking lot for a temporary period; and
recommending that:
(1) given the scale and size of this application, community consultation be obtained
at the statutory public meeting;
(2) staff be directed to prepare a Recommendations Report on the application and
provide notice of the statutory public meeting at the appropriate time; and
(3) the appropriate City officials be authorized and directed to take the necessary
action to give effect thereto.
Councillor Moscoe, North York Spadina, moved that a report be obtained from the Planning
Department staff on this application s relation to Metro Licensing By-law No. 20-85.
Councillor Moscoe requested the permission of the North York Community Council to withdraw
the foregoing motion based on the clarification received from the Acting Commissioner of
Planning that staff would be circulating this application to Metro Licensing for any
comments.
The North York Community Council concurred with Councillor Moscoe s request.
On a motion by Councillor Flint, North York Centre South, the North York
Community Council approved the foregoing report.

13. Report - Zoning Amendment Application UDOZ-88-37 - Seneca College Of Applied Arts And
Technology - 43 Sheppard Avenue East - Ward 10 - North York Centre.
The North York Community Council had before it a report (January 8, 1998) from the Acting
Commissioner of Planning advising that Seneca College is seeking a base level of zoning on
the property which would allow for redevelopment of the site; that this matter is being
brought forward at this time because the application is the subject of an Ontario
Municipal Board hearing commencing March 2, 1998; that it is necessary for Council to take
a position on the matter prior to the Ontario Municipal Board hearing; and submitting
recommendations with respect thereto.
On a motion by Councillor Filion, North York Centre, the North York
Community Council received the foregoing report and directed that a
statutory public meeting be held at a future meeting of the North York
Community Council with appropriate notice being forwarded to all concerned.

14. Recommendations Report - Official Plan And Zoning Amendment Application and Subdivision
Application UDOZ-97-34 & UDSB-1232 - Romeo DiBattista - 665 Trethewey Drive - Ward 6 -
North York Humber.
The North York Community Council had before it a report (December 30, 1997) from the
Acting Commissioner of Planning reporting on an Official Plan and Zoning By-law amendment
and conditions of Draft Plan of Subdivision approval to permit 529 townhouses and semi-
detached dwelling units fronting onto public streets and a public park; and submitting
recommendations with respect thereto.
The North York Community Council also had before a communication (January 16, 1998) from
Mr. Lorne S. Berg, Executive Director, Black Creek Business Area Association, requesting
that Lot 98 be opened as a road only if the street pattern remains in its present planned
configuration; that the City apply to the TTC for a study of ridership to determine if
increased service to the area is warranted; and further, requesting information on the
feasibility of the bus route servicing Industry Street being extended to service this new
development in the future.
A. Councillor Moscoe, North York Spadina, moved that:
(i) staff of the North York Planning and Transportation Departments submit a
joint report to the Community Council on road access between the industrial
area and the subdivision and on the feasibility of requiring a financial
contribution from the applicant for an industrial road to Trethewey Drive;
(ii) staff of the North York Transportation Department report on changes that
would be required if the tandem parking referred to in Recommendation
No. (2.8) was eliminated; and
(iii) the Councillors in the immediately adjacent Ward to the south be involved
in the consultation.
B. Councillor Sgro moved that:
(i) the foregoing report be received;
(ii) a statutory public meeting be held at a future meeting of the North York
Community Council with appropriate notice being forwarded to all concerned;
and
(iii) that an information session be held in the interim.
Upon the question of the adoption of motion A. by Councillor Moscoe, North York Spadina,
it was carried.
Upon the question of the adoption of motion B. by Councillor Sgro, North York Humber, it
was carried.

15. Recommendations Report - Official Plan And Zoning Amendment Application UDOZ-97-26
- Shell Canada Limited - 4021 Yonge Street - Ward 9 - North York Centre South.
The North York Community Council had before it a report (January 7, 1998) from the Acting
Commissioner of Planning respecting on an Official Plan and Zoning By-law amendment to
permit an upgrade to the existing gasoline station at 4021 Yonge Street, and recommending
that the report be received, a public meeting be scheduled and submitting recommendations
with respect thereto.
On a motion by Councillor Moscoe, the North York Community Council approved
the foregoing report.
The North York Community Council also had before it a communication (January 18, 1998)
from Mr. A. Mukherjee, P. Eng., Acting Manager, Program and Development Engineering,
Toronto Transportation Department, advising that a traffic impact study for this site is
not required and outlining certain changes to be made to the site plan.
Councillor Feldman, North York Spadina, declared his interest in the foregoing matter in
that he resides in the immediate vicinity of the development application.

16. Development Charges - Seneca College - Newnham Campus - Ward 12 - Seneca Heights.
The North York Community Council had before it a communication (December 31, 1997) from
Mr. Steven N. Iczkovitz, Borden & Elliot, Barristers and Solicitors, Scotia Plaza, 40 King
Street West, Toronto, M5H 3Y4, registering a complaint pursuant to section 8 of the
Development Charges Act related to the development charges imposed with respect to the
student residence presently under construction at the Newnham Campus.
On a motion by Councillor King, Seneca Heights, the foregoing communication
was referred to the Chief Financial Officer and Treasurer and the
Functional Lead for Legal Services for consideration.

17. Preliminary Evaluation Report - Official Plan and Zoning Amendment Application UDOZ-97-44 -
Tridel Builders Inc. - 1857 Leslie Street - Ward 11 - Don Parkway.
Councillor Flint requested that this matter be re-opened for the purpose of making a
further recommendation.
The North York Community Council concurred with the request by Councillor Flint.
On a motion by Councillor Flint, the North York Community Council agreed
that in light of the proximity of this application to Ward 9 - North York
Centre South, the local Councillors for Ward 9 and the community be
included in the community consultation meeting.

18. Request for Exemption - North York Noise By-law No. 31317 - Latka Construction &
Management Inc. - Construction of Mitchell Field Community Centre - Ward 10 - North York
Centre.
The North York Community Council had before it a communication (January 19, 1998) from Mr.
Rolf Latka, Latka Construction & Management Inc., 11 Derwent Court, North York, Ontario
M2M 2C4, requesting an exemption from the noise by-law for the duration of the project
(March/April 1998) to complete the construction of an addition to the existing Mitchell
Field Community Centre at 98 Church Avenue, North York.
Councillor Filion, North York Centre, moved that the request for an exemption to
North York Noise By-law No. 31317 be denied.
Councillor Gardner, North York Centre, moved that:
(1) consideration of the foregoing request contained in the foregoing
communication be deferred to the next meeting of the North York Community
Council scheduled to be held on February 18, 1998; and
(2) directed that the Functional Lead, By-law Enforcement/Licensing, be
requested to submit a report to the Community Council for consideration at
such meeting outlining the reasons for the request contained in the
communication in terms of the hours of operation required under the
exemption and whether the work is to be carried out inside or outside.
Upon the question of the adoption of the motion by Councillor Gardner, North York Centre,
it was carried.

19. Speed Bumps on Post Road and Park Lane Circle - Ward 9 - North York Centre South.
The North York Community Council deferred consideration of the following Notice of Motion
dated January 21, 1998, from Councillor Howard Moscoe, North York Spadina, until its next
meeting scheduled to be held on February 18, 1998:
WHEREAS North York has had a long standing policy against speed bumps on
public roadways; and
WHEREAS that policy was violated without the full knowledge of Council when
road resurfacing projects were approved for Post Road, The Bridle Path,
High Point Road and Park Lane Circle in the dying days of North York
Council; and
WHEREAS this action violated a long standing understanding that these roads
are used as the alternative to completing Lawrence Avenue East from Bayview
Avenue to Leslie Street; and
WHEREAS this action will establish a precedent that will result in similar
requests throughout the community;
NOW THEREFORE BE IT RESOLVED THAT the North York Community Council either
take action to have the speed bumps recently installed on Post Road and
Park Lane Circle ground down, or alternatively, advise Toronto Council that
it favours the completion of Lawrence Avenue East from Bayview Avenue to
Leslie Street.

20. Request for Amendment to subsection 8(4) of Bill 103.
The North York Community Council referred the following Notice of Motion dated January 21,
1998, from Councillor Denzil Minnan-Wong, Don Parkway, to the Functional Lead for Legal
Services with a request the he submit a report thereon to the next meeting of the North
York Community Council scheduled to be held on February 18, 1998:
WHEREAS the North York Community Council recognizes the importance of
local decision making as crucial to the success of the City of Toronto; and
WHEREAS the North York Community Council recognizes that some issues are
best decided by local Community Councils; and
WHEREAS the City of Toronto Act, 1997 (Bill 103) is incomplete in dealing
with Community Councils because the intended authority to allow additional
functions to be assigned to Community Councils does not appear in the final
version of Bill 103; and
WHEREAS it should be Council's role to decide what functions, if any,
should be assigned to Community Councils for final decision;
NOW THEREFORE BE IT RESOLVED THAT the Ontario Legislature be petitioned on
an urgent basis to amend Bill 103 by deleting the current subsection 8(4)
and substituting a provision substantially as follows:
8(4) The City Council may, by by-law, assign to a Community Council,
with respect to the part of the urban area that it represents, any
function that City Council may carry out in respect of that part of
the urban area.
8(4.1) Without limiting the generality of subsection (4), the City Council
may assign to a Community Council the authority to make
recommendations for by-laws which recommendations, subject to
subsection (7), oblige the City Council to act under subsection
(6).
AND BE IT FURTHER RESOLVED THAT this resolution be circulated to the other
Community Councils in the City of Toronto.

21. Discharge of Storm Water into the Sanitary Sewer System - 20 Donewen Court.
On a motion by Councillor Minnan-Wong, Don Parkway, the North York Community Council
concurred with the following motion:
The Functional Lead for Legal Services and the Functional Lead for Public
Works be directed not to proceed with the prosecution, scheduled for
January 23, 1998, under the North York By-law No. 31442, as amended, of
the owner of 20 Donewen Court for discharging storm water into the sanitary
sewer, at this time, in order to allow further discussion with the local
Councillors to determine if the problem can be resolved without undue costs
and inconvenience to the property owner.

22. Funding for North York Neighbourhood Watch.
The North York Community Council deferred consideration of the following Notice of Motion
dated January 21, 1998, from Councillor Denzil Minnan-Wong, Don Parkway, until its next
meeting scheduled to be held on February 18, 1998:
WHEREAS community safety is a priority to the residents of the North York
community; and
WHEREAS the Toronto Police Service has received fewer resources in the last
number of years and have come to rely more and more on Neighbourhood Watch;
and
WHEREAS the North York community has come to rely and depend on
Neighbourhood Watch as an effective way of protecting our communities; and
WHEREAS Neighbourhood Watch has been an unqualified success in promoting
community safety and crime prevention;
NOW THEREFORE BE IT RESOLVED THAT the North York Community Council endorse
Neighbourhood Watch as integral in fighting crime and promoting crime
prevention in the City of Toronto;
AND BE IT FURTHER RESOLVED THAT the North York Community Council adopt
Neighbourhood Watch as a model for establishing community safety and crime
prevention programs;
AND BE IT FURTHER RESOLVED THAT funding for Neighbourhood Watch in North
York be continued;
AND BE IT FURTHER RESOLVED THAT this resolution be circulated to all other
Community Councils in the City of Toronto.
