Sidewalk Patios in Etobicoke/York
Restaurant/cafe owners can apply for a sidewalk patio (boulevard cafe) encroachment to allow them to serve on the public right-of-way (sidewalk). If you have a new business licence for an establishment with an existing encroachment agreement, the permit must be transferred to the new owner.

How To Apply
Apply in person at Municipal Licensing and Standards’ Etobicoke/York District Office at the Etobicoke Civic Centre, 399 The West Mall, North Block, 3rd Floor
If the applicant is an agent of the business owner, a letter signed by the owner, authorizing the agent to act on the owner’s behalf is required.
The application fee to operate a sidewalk patio is non-refundable, and depends on the business location. Cheques should be made payable to the Treasurer, City of Toronto.
An additional fee for the permit is required once the application has been approved, and must be paid on an annual basis.
$11 per square metre, plus HST in Etobicoke
$5.50 per square metre, plus HST, plus $25 administration fee in York
Awning: $5.50 per square metre, plus HST
Applicant will be contacted if more information is required or if the application is incomplete. The application process will not proceed until all information is received.
Drawings of Proposed Patio and any Awnings and Enclosures
- one copy of an up-to-date plan of survey
- one copy of professionally prepared site plan showing the location of the proposed outdoor cafe in relation to the city’s street line, sidewalk, utility poles, fire hydrants and trees
- proposed landscaping on City property requires a detailed landscape plan (one copy)
- description of any proposed paving material
- one copy of professionally prepared elevation drawing depicting any fencing, awning, etc.
- drawings must be submitted electronically and in AutoCad
Provide a certificate of insurance evidencing a third party bodily injury and property damage insurance in an amount of $2,000,000.
City of Toronto must be added as an additional insured party under the policy.
What Happens After You Apply
The application process will take a minimum of 12 weeks.
- The application is circulated to different City divisions and utility companies for comment
- A report is drafted and the application is considered by Community Council
Should the Application be Approved:
- Applicant must enter into encroachment agreement with the City.
- Additional legal fees may be charged
- Pay an annual fee to the City for the use of road allowance and comply with any conditions the City may impose.
- Obtain a construction/street occupation permit prior to the start of any construction.
- Remove the cafe and all of its components no later than November 1st of each year
