Final Report - 301 Front Street West - Official Plan Amendment and Rezoning

Recommendations

The City Planning Division recommends that:

 

1.         City Council amend the Official Plan for the lands at 301 Front Street West substantially in accordance with the draft Official Plan Amendments attached as Attachments No. 12 and No. 13 to the May 31, 2010 report from the Director of Community Planning, Toronto and East York District.

 

2.         City Council amend Zoning By-laws 168-93 and 1994-0806, for the lands at 301 Front Street West substantially in accordance with the draft Zoning By-law Amendments attached as Attachments No. 14 and No. 15 to the May 31, 2010 report from the Director of Community Planning, Toronto and East York District.

 

3.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendments and draft Zoning By-law Amendments as may be required.

 

4.         Before introducing the necessary Bills in Council for enactment, City Council require the owner to enter into a CN Tower Precinct Amending Agreement in order to update the CN Tower Precinct Agreement provisions relating to the publicly accessible open space, and to otherwise update the agreement as follows:

           

a.         Revisions relating to the provision of publicly accessible open space (Section 3.1 and Schedule D) as follows:

 

i.          Revise Section 3.1, Clause (a) to secure the provision of 1.09 hectares rather than 1.29 hectares of publicly accessible open space.

 

ii.         Provide for the phasing of the publicly accessible open space expenditures, including requiring a minimum of $1,000,000 of the required minimum expenditures to be spent on the CN Tower Expansion site in connection with Phase 2A.

 

iii.        Insert a provision allowing expenditures made on interim improvements to the Phase 2 lands in connection with the construction of Phase 1 to be applied towards the minimum expenditure, but only until such time as Phase 2 proceeds, at which time the amount spent on those interim improvements would be added to the outstanding amount owing.

 

iv.        Provide that a portion of the minimum expenditure may be spent on the CN Tower Expansion site in advance of the construction of Phase 2A, so long as these expenditures are for improvements to the publicly accessible open space that are intended to be permanent and not of an interim nature.

 

v.         Add new clause to allow a portion of the required minimum expenditure to be spent on other publicly accessible open spaces in the area (including the John Street Corridor and John Street Bridge), if there are excess funds.

 

vi.        Clarify the requirement for the provision of an enclosed or weather-protected publicly accessible pedestrian walkway along the northern edge of the site, including a link from the Skywalk to the open space to the west of the Aquarium, either as internal to Phase 2 of the Aquarium, or otherwise, should Phase 2 not proceed within 20 years.

 

vii.       Revise the Schedule “D” Guidelines to accurately reflect the current proposal; to ensure that the lighting provisions reflect the Bird-Friendly Guidelines; and to attach a map showing the location of the 1.09 hectares.

 

b.         Revisions and deletions of provisions that are spent or otherwise inapplicable to the current proposal as follows:

 

i.          Delete the reference to the MTCC/Tower Park East Bridge Connection in Article 2 of the Precinct Agreement - Interim Obligations for Tower Park Lands and Part 44 lands.

 

ii.         Delete Section 3.2 - Part 44 lands of the Precinct Agreement.

 

iii.        Delete Section 3.3 - CN Tower Expansion Public Room of the Precinct Agreement.

 

iv.        Delete Section 3.4 -Connections with the Metro Toronto Convention Centre of the Precinct Agreement.

 

c.         Any other technical amendments to update the agreement to reflect the precinct arrangements, new addresses for notices, and updated studies as described in this report.

 

5.         City Council grant authority to enter into a CN Tower Precinct Amending Agreement, incorporating the necessary amendments, satisfactory in form to the City Solicitor.

 

6.         City Council authorize the appropriate City officials to take the necessary steps to implement the foregoing.

Summary

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes to amend the Railway Lands Central and East Secondary Plans and the Railway Lands Central and East Zoning By-laws to permit a 14,000 square metre aquarium to the east of the CN Tower, and a 4,400 square metre commercial building on the west side of the base of the CN Tower. A mix of uses around the base of the CN Tower is currently permitted. This application will re-deploy that density to accommodate the proposed uses.

 

The proposed uses and density are consistent with existing permissions for the site.  The proposed aquarium use will complement the existing tourist and entertainment uses in the area. The proposal addresses the relevant policy objectives of the Railway Lands Central Secondary Plan.

 

This report reviews and recommends approval of the applications to amend the Official Plan and Zoning By-law.

The City Planning Division recommends that:

 

1.         City Council amend Zoning By-law 1-83, By-law 3623-97, as amended, and By-law 12349, for the lands at 1950 Bathurst St., 89 Dewbourne Avenue, and 84 Ava Road, substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 1 to the report dated June 16, 2010, from the Director, Community Planning, Toronto and East York District.

 

2.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

 

3.         City Council require that the Owner agree to implement the measures outlined in the December 2009 Transportation Demand Management Plan, prepared by BA Group, as part of the Site Plan Agreement.

 

4.         City Council require that the Owner pay for and construct any improvements to the municipal infrastructure in connection with the Preliminary Servicing Report, as accepted by the Executive Director of Technical Services, should it be determined that improvements to such infrastructure are required to support this development.

Summary

This report recommends that Recommendations Section, in the final staff report dated May 26, 2010, be revised, in order to delete Recommendation Nos. 3 and 5.

 

This report recommends that the draft By-law be revised in order to correctly amend the applicable Zoning By-laws and Maps. The revised draft by-law is included as Attachment 1 in this report.

Recommendations

The General Manager of Parks, Forestry and Recreation recommends that Toronto and East York Community Council:

 

1.         Approve the park name “Sherbourne Common”, selected by Toronto residents in the public naming competition for the new park in the East Bayfront neighbourhood, located on the north and south sides of Queens Quay East, just east of lower Sherbourne Street with the judging criteria respecting the City’s parameters for naming parks.

This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision.

 

This report responds to the direction of Toronto and East York Community Council, at its March 9th, 2010 meeting (TE32.19), authorizing a public competition to select a name for the new park in the East Bayfront neighbourhood, located on the north and south sides of Queens Quay East, just east of Lower Sherbourne Street. The competition has ended and the new name chosen is “Sherbourne Common.”

 

The Parks, Forestry, and Recreation Division is recommending that the park name selected by Toronto residents, “Sherbourne Common,” be officially adopted as the name of the new park.

1.         Approve the widening of Fermanagh Avenue, from a width of 4.3 metres to a width of 7.3 metres by removing a modular traffic island/planter box currently located on the south side of Fermanagh Avenue, east of Roncesvalles Avenue, generally as shown on Drawing Nos. 421G-0062, dated June 2010, attached to the report dated June 7, 2010 entitled, “Roadway Alterations – Fermanagh Avenue, Galley Avenue and Ritchie Avenue”, from the Director, Transportation Services Toronto and East York District.

Transportation Services is requesting approval from Toronto and East York Community Council to widen Fermanagh Avenue and narrow Galley Avenue, Ritchie Avenue, in accordance with Item PW24.5, containing a staff report (April 20, 2009) entitled “Roncesvalles Avenue Streetscape Improvements – Class Environmental Assessment Study” from the General Manager, Transportation Services, that was adopted by City Council at its meeting held on May 25, 26 and 27, 2009. 

 

The alterations to Galley Avenue and Ritchie Avenue will enhance pedestrian safety by providing a wider sidewalk.  Removal of the modular traffic island/planter box on Fermanagh Avenue will provide for a planned cycling lane on the street.

Financial Impact

The estimated cost of the roadway alterations outlined in this report is $250,000.00. Funds for this project are available within the 2010 Capital Budget (Roncesvalles Avenue Road and Sidewalk Works – 10EY-08RD)

1.         Rescind the existing 10-minute maximum parking limit from 7:30 a.m. to 9:30 a.m., 11:15 a.m. to 1:15 p.m., and from 3:30 p.m. to 6:30 p.m., Monday to Friday, on the west side of Hilton Avenue, from a point 36 metres north of the west branch of Austin Terrace to a point 17 metres south of Nina Street.

 

2.         Approve parking for a maximum period of 10-minutes from 7:30 a.m. to 9:30 a.m., 11:00 a.m. to 1:15 p.m., and from 3:00 p.m. to 6:30 p.m., Monday to Friday, on the west side of Hilton Avenue, from a point 36 metres north of the west branch of Austin Terrace to a point 17 metres south of Nina Street.

The purpose of this report is to amend the existing hours of operation of the student pick-up and drop-off zone on the west side of Hilton Avenue in front of Hillcrest Community School.  In conjunction with these amendments it would also be necessary to adjust the times of the entry restrictions onto Hilton Avenue at the west branch of Austin Terrace.

 

These amendments would address the recent changes to the school’s lunch time and afternoon pick-up and drop-off times without impact to traffic operations on Hilton Avenue, between the west branch of Austin Terrace and Nina Street.

Financial Impact

The estimated cost of $2,000.00 for implementing the proposed changes is contained in the Transportation Services Division 2010 Operating Budget.

Transportation Services, Toronto and East York District, recommends that:

 

1.         City Council approve implementation of “No Right Turn on Red” regulations at the following locations and in the directions indicated:

 

a.         eastbound and westbound from College Street onto Spadina Avenue; 

b.         eastbound and westbound from College Street onto Beverley Street and St. George Street, respectively;

c.         northbound from Beverley Street onto College Street;

d.         southbound from St. George Street onto College Street;

e.         northbound from St. George Street onto Hoskin Avenue;

f.          southbound from St. George Street onto Harbord Street;

g.         eastbound from Harbord Street onto St. George Street;

h.         westbound from Hoskin Avenue onto St. George Street;

i.          northbound and southbound from Bay Street onto Bloor Street West

j.          eastbound and westbound from Bloor Street West onto Bay Street; and

k.         eastbound and westbound from Harbord Street onto Spadina Avenue.

 

2.         City Council authorize and direct the appropriate City officials to take the necessary action to give effect thereto, including the introduction of all necessary bills.

Summary

This report is requesting approval from City Council to install “No Right Turn on Red” regulations at the following five (5) intersections in the Toronto and East York District:

 

-           College Street and Spadina Avenue;

-           College Street and St. George/Beverley Street;

-           Harbord Street and Spadina Avenue;

-           Harbord Street/Hoskin Avenue and St. George Street; and

-           Bloor Street West and Bay Street.

 

Prohibiting right turns on red at the selected intersections is designed to promote pedestrian safety and is required in order to install bike boxes and a pedestrian scramble intersection. Bike boxes will be installed at the College Street and Harbord Street/Hoskin Avenue intersections and the pedestrian scramble operation will be installed at the intersection of Bloor Street West and Bay Street. The installation of bike boxes and the pedestrian scramble operation will increase pedestrian and cyclist safety and decrease potential collisions with right turning vehicles. Further, the recommended “No Right Turn on Red” regulations will have a minimal affect on traffic operations based on the volume of vehicles currently making the right turn on red manoeuvre.

 

The pedestrian priority phase at the Bloor Street West and Bay Street intersection was "approved by City Council at its meeting on October 22 and 23, 2007 in considering the report titled ‘Sustainable Transportation Initiatives: Short-term Proposals’ (PW9.2)".

Financial Impact

All costs associated with the installation of the “No Right Turn on Red” regulations are included within the Transportation Services Division’s 2010 Operating Budget estimate.

 

The funds to implement the bike boxes identified in this report are available within the Transportation Services Division 2010 Capital Budget in the Cycling Infrastructure Account CTP 810-05.

Recommendations

Transportation Services recommends that Toronto and East York Community Council:

 

1.         Authorize the City Clerk to conduct a poll of eligible householders in English, on Northdale Boulevard and on Northline Road, between Northdale Boulevard and Curity Avenue, to determine resident support for the proposed speed hump plans, in accordance with the City of Toronto Traffic Calming Policy.

 

2.         Subject to favourable results of the poll, request:

 

a.         The City Solicitor to prepare a by-law to alter sections of the roadway on Northdale Boulevard and on Northline Road, between Northdale Boulevard and Curity Avenue, for traffic calming purposes, generally as shown on the print Drawing No 421G-0013 and No. 421G-0033, respectively, dated May, 2010, attached to the report dated June 4, 2010, from the Director, Transportation Services, Toronto and East York District, and circulated to residents through the polling process; and

 

b.         Transportation Services to take the necessary actions to reduce the speed limit to 30 km/h on Northdale Boulevard and on Northline Road, between Northdale Boulevard and Curity Avenue, when the speed humps are installed.

 

3.         Rescind the existing Yield sign control on Curity Avenue at Northline Road.

 

4.         Approve the installation of an All-way Stop control at Northline Road and Curity Avenue as the warrant criteria has been met.

 

5.         Reduce the existing speed limits from 50 km/h to 40 km/h on the following streets:

 

             Northdale Boulevard

             Northline Road, between Northdale Boulevard and Hollinger Road;

             Hollinger Road, between Northdale Boulevard and Curity Avenue;

             Cranfield Road, between Northdale Boulevard and Bermondsey Road;

             Curity Avenue, between Northline Road and Hollinger Road;

             Waterman Avenue, between Northline Road and Cranfield Road; and

             Dohme Avenue, between Northline Road and O’Connor Drive.

 

6.         Approve the alteration of Northdale Boulevard at Northline Road in the form of a modular traffic island, generally as described in Drawing No. 421F-9529, dated January, 2009, attached to the report dated June 4, 2010, from the Director, Transportation Services, Toronto and East York District.

 

7.         Direct Transportation Services to install Heavy Truck Route signs on Northline Road directing heavy trucks to use Curity Avenue, Dohme Avenue or Bermondsey Road to access O’Connor Drive and at St. Clair Avenue West and O’Connor Drive directing them away from the Parkview Hills area.

Summary

This staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

After extensive community consultation, Transportation Services has been requested by Councillor Janet Davis to implement various traffic improvements in the vicinity of Northdale Boulevard.

 

The proposed traffic modifications will promote slower vehicle operating speeds, discourage heavy truck traffic in the residential area, and provide for a safer pedestrian environment in this vicinity.  There are no impacts to TTC service routes.

Financial Impact

The estimated cost for installing 5 speed humps would be $15,000.  Funds in the amount of $418,000 have been allocated in the Transportation Services 2010 Capital Budget for traffic calming initiatives.  Installing speed humps on Northdale Boulevard and Northline Road is subject to competing priorities and funding availability.

 

The estimated cost for installing a modular traffic island and the various required signs is $5,000, funds for which are available in the Transportation Services 2010 Operating Budget.

91a Request from GreekTown BIA for Extension of Flankage Patio Hours

Summary

This letter is in response to the June 4, 2010 e-mail from Ms. Faiza Ansari, Senior Manager of Operations for the GreekTown on the Danforth BIA with a request for an extension to the flankage patio hours during the summer months (May-September). In her correspondence, Ms. Ansari states that in this difficult economy the GreekTown on the Danforth BIA would like their businesses to be able to maximize on the brief amount of summer patio weather there is and is therefore requesting an extension of flankage patio hours.

 

In response to this request, as ex-officio members of the BIA board, we would like to recommend a Pilot Project for the GreekTown on the Danforth BIA be approved in Ward 29 and Ward 30 to extend the flankage patio hours from 11:00 p.m. to midnight during the months of May to the end of September for the following businesses and their patios:

When the pilot project is complete, we would request that Municipal Licensing and Standards staff report back to Toronto and East York Community Council on results and the feasibility of extending this exemption in future years.
