New Early Resolution Process:
The Provincial Offences Act has been amended to provide for Early Resolution Meetings as of March 31, 2012. This process offers a wider range of options for defendants who have received a POA Part 1 Offence Notice. Now, a person receiving an offence notice (ticket) has the opportunity to schedule a meeting with a prosecutor to discuss the possibility of resolving the matter without the need for a trial.
By checking the box under "Option 2, Early Resolution," on the back of your ticket and mailing it to the Court Office on the back of your ticket within 15 days, the court office will mail back an Early Resolution Meeting Notice, advising you of the time and place of the meeting. If you cannot attend the scheduled meeting; and you give at least two days written notice of that to the court office, the meeting can be re-scheduled once only to a new date within 30 days of your initial meeting date.
The Early Resolution process will benefit defendants by:
- Providing a mail-in method of scheduling a meeting with a prosecutor before a trial is requested, simplifying access to prosecutors.
- Providing a telephone (remote) meeting option for defendants who live 75 kilometers or more from the court office.
