Subject:Preliminary Report, Amendments to the Zoning Code, Zanini Developments Inc., 112 Evans Avenue, 801 Oxford Street, File No: Z-2268(Lakeshore -Queensway)

Purpose:

To provide preliminary comments on the processing of an application received on April 29, 1998, from Zanini Developments Inc. to amend the Class 1 Industrial (I.C1) zoning of a vacant site at 112 Evans Avenue and 801 Oxford Street, to permit a 142-unit, townhouse development.

Funding Sources, Financial Implications and Impact Statement:

City funding is not required. There are no impacts on capital or operating budgets.

Recommendation:

It is recommended that this report be received for information purposes and the application continue to be processed.

Comment:

Reason for Application:

On September 22, 1997, Etobicoke Council approved an application submitted by 1215295 Ontario Ltd. to amend the Official Plan from Industrial to Residential Medium Density and Zoning Code from Class 1 Industrial (I.C1) to Group Area Fourth Density Residential (R4G) and Third Density Residential (R3) to permit a 86-unit residential development on the subject lands.

While Official Plan Amendment No. 52-97 was adopted, redesignating the lands to Medium Density Residential, the applicant did not complete the conditions of approval required prior to the passage of the zoning by-law. Rezoning therefore is still required to permit the form of residential development proposed.

This project has now been assumed by Zanini Developments Inc. who is seeking to increase the density of the previous proposal from 86 to 142 units.

Issues:

No city wide issues have been identified. Local issues include: tenure, integration within the neighbourhood context (i.e. Evans Avenue/Oxford Street frontages), development intensity, on-site amenity space, urban design, access/egress, parking and circulation, soil remediation and emergency access.

Status:

The application is in circulation. A staff report on the application is expected to be available in the fall of 1998. The Public Meeting will be held by Etobicoke Community Council and will be scheduled at the earliest possible date following the receipt of the staff report. A Community Meeting will be held prior to the staff report being tabled, if deemed necessary by the Ward Councillors.
