Subject:Appeal of Committee of Adjustment Decision
Purpose:
To advise Toronto Council of a Committee of Adjustment Decision which has been appealed to the Ontario Municipal
Board and to recommend whether legal and staff representation is warranted.
Funding Sources, Financial Implications and Impact Statement:
There will be no financial costs associated with the appeal as no legal representation is recommended.
Recommendation:
It is recommended that legal and staff representation not be provided for the appeal regarding Application No.
A-269/98ET, 52 Radwinter Drive.
Comment:
The application and appeal is summarized as follows:

Application:The site is occupied by a one-storey, semi-detached dwelling and a detached single car garage. The
applicants have constructed an enclosed front porch without a building permit. The applicants seek to legalize and
maintain the enclosed front porch which was built at the northwest corner of the dwelling, 5.85 m from the north front lot
line, while a minimum 7.68 m distance is required by the Zoning Code.
Decision of Committee of Adjustment:Refused.
Conclusion:
The subject appeal was reviewed by staff who are of the opinion that it does not involve substantive planning issues,
legal and staff representation at the Ontario Municipal Board is therefore not warranted.
