 Subject:Application for Condominium Approval

7 Overlea Boulevard - Ward 1

 Purpose:

 This is an information report to the May 27, 1998 meeting of the East York Community Council.

 Invar Building Corporation submitted an application for Draft Plan of Condominium approval for 144 residential apartment units and two commercial units in the building at 7 Overlea Boulevard. The building is an existing 7-storey building that the applicants are converting from office uses to mixed commercial and residential uses. The applicants anticipate that the building will be ready for occupancy this summer.

 Condominium approval authority was previously delegated by the Province to Metropolitan Toronto. The previous Metropolitan Council, in turn, delegated this authority to the Commissioner of Planning. Staff of the new City of Toronto are in the process of formulating recommendations for Abest practices@ to be employed by the City to process applications. These have to be approved by the Toronto City Council. Until this matter is resolved, the previous procedures are still in effect. Thus this report is being submitted to the East York Community Council for information only. Staff=s recommended conditions of approval will be forwarded to the appropriate City official for approval pursuant to the delegated authority.

 Recommendations:

 It is recommended that East York Community Council receive this report as information.

 Background:

On May 20, 1997, former Borough of East York Council passed a zoning by-law amendment to permit the existing office building on the site to be converted to a residential apartment building with 144 one-bedroom units, and 2,033 m2 of commercial floor area on the ground floor. The Official Plan was modified by the Minister of Municipal Affairs to allow residential zoning on the site. Both the Official Plan modification and Zoning By-law Amendment are in effect.

 The former East York Council approved an application for site plan approval for the site on August 11, 1997. The owners entered into a Site Plan Development Agreement with the City of Toronto, and the Agreement was registered on title on February 26, 1998.

 Comments:

 The applicants are proposing to create two commercial condominium units on the ground floor; 144 residential condominium units on second floor through the seventh floor; 144 locker units on the second floor through the seventh floor; 238 parking spaces; and one communications unit in the mechanical (roof) level.

 Staff circulated this application to the usual commenting agencies. No concerns have been raised.

 Conclusions:

 Staff are recommending that the Draft Plan of Condominium 55CDM-98014 for Invar (Leaside) Limited, for 7 Overlea Boulevard be approved by the appropriate delegated City of Toronto official, and that this approval be subject to the following conditions:

 

  1. The approval shall apply to the Draft Plan of Condominium of Part of Block F, Plan M-736, City of Toronto, prepared by Vladimir Krcmar Ltd., under Job No. 97016;

 

  1. The City of Toronto standard form of condominium agreement shall be executed by the Developer, the City and all Encumbrancers within six months of the giving of the City=s approval to the draft plan of condominium;

 

  1. The Developer shall submit the condominium declaration and by-laws to the City Solicitor for his approval and clearance by the City of the draft plan of condominium for registration;

 

  1. The architect and/or professional engineer who undertook the design and review of the construction shall certify that the buildings Ahave been constructed@ as defined by Section 7 of Ontario Regulation 97 under the Condominium Act. Such certification shall be accompanied by Aas built@ drawings and two copies of an updated, certified site survey plan showing all relevant dimensions and setbacks certified by a responsible architect or engineer;

 

  1. The Developer shall provide the City with confirmation from Toronto Hydro that all of their requirements have been satisfied, including:

 

    1. that a Hydro Servicing agreement has been entered into; and

 

    1. that adequate provision has been made for the granting of any easements or rights-of-way that may be required for Hydro purposes and that any agreements respecting Hydro services have been entered into with Toronto Hydro, including any easements, rights-of-way or agreements required with the Condominium Corporation, at no cost to the utility;

 

  1. The Agreement referred to in condition No. 2 above shall provide that the owner and/or the Condominium Corporation shall grant to the City of Toronto or to any public utility, such easements or rights-of-way as may be necessary to service the subject lands with such utility at no cost to the utility;

 

  1. The Developer shall provide the City with confirmation from Bell Canada that satisfactory arrangements, financial or otherwise, have been made with Bell Canada for any Bell Canada facility servicing the draft plan of condominium which are required by the City to be installed;

 

  1. The Developer shall provide the City with confirmation from Canada Post that adequate arrangements have been made for the installation of a central mail facility;

 

  1. The thirty-six (36) visitor parking spaces on Parking Area No. 5 shall not be utilized or made exclusive use components of the common element;

 

  1. The Developer shall register on title notification to purchasers of commercial units (Unit 1 and Unit 2) that the ground floor may be used for commercial purposes only, in wording satisfactory to the City Solicitor.
