(Report dated June 11, 1998, addressed to East York Community Council, from the Commissioner of Development Services.)

Subject:STATUS REPORT - CASH-IN-LIEU OF PARKING APPROVAL, Restaurant Use, 1677 Bayview Avenue, CASH.8, Ward 1 - East York

Purpose:

The Planning Division (East York Division) have been requested by members of Council to submit a status report subsequent to the approval of the Cash-in-Lieu of Parking Report for 1677 Bayview Avenue (See schedule "1"), which was adopted without amendment by Council on May 14, 1998 (See schedule "2").

Recommendation:

That this report be received for the purpose of information.

Background:

Status Subsequent to Council Approval

May 13/98- City Council Approval of Cash-in-Lieu of Parking for 1677 Bayview Avenue.

May 14/98- Payment made by applicant for Cash-in-Lieu of Parking ($11,827.50)(See schedule "3")

May 27/98- Agreement was mailed to the owner of property to be signed.

June 4/98- Building permit was issued (See schedule "4").

Comments:

The subject proposal was mailed to several different agencies and departments, including the Leaside Property Owners' Association (See schedule "5") . The LPOA did not return a comment.

Conclusion:

Committee of Adjustment file No. A.149/97 was approved by the Committee of Adjustment on January 20, 1998 (See Appendix "B" of Schedule "1"). The application was appealed to the Ontario Municipal Board. The hearing is scheduled for June 29, 1998.

As noted in the attached Schedule "1", this Ontario Municipal Board hearing may no longer be necessary given Council's approval of the alternate application, namely, cash-in-lieu of parking. If the Ontario Municipal Board proceeds with the hearing and supports the minor variance for parking, then the property owner will have the additional benefit of a parking variance. On the other hand, if the Ontario Municipal Board denies the minor variance, the owner already has received Council approval under the Planning Act for cash-in-lieu of parking. Both techniques are legal and have been used on many occasions in the past.

It is also worth noting, that as part of a parking study, staff recommended on August 22, 1997, that the restaurant parking standards on Bayview Avenue be reduced to the general commercial standard. However, Council did not support the staff recommendation and instead requested staff to report further regarding the discrepancy between the results of the study and the shortage of parking supply. Staff reported back to Council on September 15, 1997. Again, Council did not support staffs original recommendation to reduce the commercial parking standard.
