 Subject:Public Notification for Cash-In-Lieu of Parking Applications

  Purpose:

 To respond to the East York Community Council's request from their June 24th, 1998 meeting requesting a staff report on establishing public notification procedures for cash-in-lieu of parking applications.

  Source of Funds:

 The cost of notifying members of the public about cash-in-lieu of parking applications has not been budgeted in the 1998 operating budget.

  Recommendation:

 That this report be received for information.

  Background:

 Cash-in-lieu of parking is a procedure established by the Planning Act. It allows applicants to apply for a cash-in-lieu of parking payment when their proposed land use does not meet the parking requirements established in the zoning by-law. This benefits the City since the cash payments can be used to supplement funds required for the building of municipal parking lots.

 Unlike many other procedures established under the Planning Act, such as: official plan amendments, zoning by-law amendments and committee of adjustment matters, the Planning Act does not require municipalities to provide any notice to the public of applications for cash-in-lieu of parking. None of the former municipalities in the new City of Toronto provided notice to the public in the past.

 Discussion:

 Staff of both the Works and Emergency Services and Urban Planning and Development Services departments are currently reviewing the existing policies and procedures with respect to cash-in-lieu of parking applications. Staff will present the findings of this review in a future joint report to the Urban Environment and Planning Committee. Subsequently, a further report will be prepared recommending the policies and procedures to be established for all of the Community Council areas of the City. We feel that it is important that a common and consistent method of dealing with these applications should be established for the City. This subsequent report will include a discussion of notification to the public of cash-in-lieu applications.

 Until the best practices have been adopted by Council, staff recommend that the current practices in place in each of the former municipalities be used to process cash-in-lieu of parking applications. Interim policies established in each Community Council are not recommended, since they may result in confusion to staff, applicants and the public. We expect to be able to report to the Urban Environment and Development Committee on this matter in the near future.

  Conclusions:

 Staff will be reporting on this matter to the Urban Environment and Development Committee in the near future. Until that time, we recommend that the current practices used in the former municipalities remain in place.
