SUBJECT: SIDEWALK (SOUTH SIDE)
ORMONT DRIVE, SIGNET DRIVE TO WESTON ROAD
WARD NO. 6 - NORTH YORK HUMBER
Purpose:
To consider reimbursement to Apotex Inc. for the cost of the construction of a sidewalk on the south side of Ormont Drive between Signet Drive and Weston Road.
Source of Funds:
Funding is available from the 1997 yearly budget item for new sidewalk construction.
Recommendations:
It is recommended that the North York Community Council consider the following options:
1. Reimburse Apotex Inc. for the full cost of the sidewalk construction on Ormont Drive in the amount of $34,909.17.
2. No reimbursement of costs to Apotex Inc., for the sidewalk construction.
3. A partial reimbursement of costs to Apotex Inc., for the sidewalk construction.
Background:
In September of 1997, Mr. Geoff Sheffrin, P. Eng., General Manager of Facilities for Apotex Inc., held discussions with the Public Works Department, expressing a need for a sidewalk on Ormont Drive between Weston Road and Signet Drive. Apotex Inc. occupies buildings at 150 Signet Drive and 4100 Weston Road, and their employees travel between the two buildings frequently during the day. Apotex Inc. is concerned for the employees' safety.
The Transportation Department conducted a Hazard Exposure Index (H.E.I.) for Ormont Drive between Signet Drive to Weston Road and advised that the Hazard Exposure Index falls within Category 1, the highest category for installation.
The Public Works Department advised Apotex Inc. that due to the timing of the request, Council was not in session to approve funds to construct a sidewalk on Ormont Drive in the 1997 construction year. In further discussion between Apotex Inc. and the Public Works Department, Apotex Inc. agreed for the City to proceed at their own expense and to pay the City of North York the cost of the construction of sidewalk, including engineering fees. However, Apotex Inc., indicated that they would like to seek consideration for reimbursement from the City when Council reconvenes in 1998. Apotex Inc.'s October 6, 1997 and November 5, 1997 dated correspondence is attached to this report.
On November 11, 1997, Apotex Inc. deposited a cheque with the City of North York for $50,000.00 being the estimated cost of the sidewalk and engineering fees.
The construction of the sidewalk has been completed. The final construction cost is $34,909.17 ($29,545.80 plus engineering fees of $5,363.37).
Conclusion:
The construction of a sidewalk on the south side of Ormont Drive between Signet Drive and Weston Road is complete. The Community Council is being requested to consider whether or not to reimburse Apotex Inc. for the cost of the sidewalk construction on Ormont Drive from Signet Drive to Weston Road.
