 Subject:Replacement Housing Guidelines By-law;

By-law Number 32892

Purpose:

To report a successful result in a number of appeals of City of North York By-law 32892 to the OMB.

It is recommended that this report be received for information.

Council Reference / Background / History:

By-law 32892 was passed by the Council of the (former) City of North York on November 27, 1996. The purpose of this by-law is to further refine the zoning performance standards which apply to replacement housing in existing residential zones.

The by-law was appealed by Norton Builders, The Noik Group of Companies, Shohreh Enterprises Inc. and Integral Design Associates.

Comments

Staff of the Legal Department attended before the Ontario Municipal Board for the hearing of the appeal of the above-noted by-law.

At that time, subject to one minor modification concerning first floor elevations of additions to existing houses, the by-law was upheld. Attached is a copy of the Ontario Municipal Board Order issued February 20, 1998 for your reference.

Conclusions:

This report is for Council's information.
