Subject:Illuminated Roof Sign at 4640 Jane St. ( Black Creek )

(Sign Application No. S98-3005)

Purpose:

Evaluate and make recommendations regarding a request by Just Cole of Pattison Outdoor Signs for a variance from the sign by-law to permit the erection of an illuminated off-premise roof sign at the above noted location. The property is located at the south west corner of Jane St. and Shoreham Dr.. Refer to attachment for details.

Recommendations:

It is recommended that:

(1)The request for a minor variance from the sign by-law be approved.

Council Reference/Background/History:

Just Cole of Pattison Outdoor Signs is requesting permission to install an illuminated off-premise roof sign on the roof of the 2 storey medical/office use building located at the above noted location. The area of the proposed sign is 200 square feet.

The building is located in a RM4 zone where roof signs are not permitted. A site specific by-law number 24808 allowed commercial uses for that zone and it would be reasonable to consider some relief from the more stringent requirements, in the sign by-law, relating to residential zones and to assume that the provisions for roof signage in a commercial zone should be applied in this instance. In this situation, section 5.2.1 of the sign by-law would apply and the roof sign would be permitted. The permitted area of a roof sign in a commercial zone is 349.8 square feet and there are no other roof sign within 500 feet of this proposed roof sign. As such the proposed roof sign would comply with the sign by-law if in a commercial zone.

A site inspection to consider the impact of the proposed roof sign on the surrounding area in general has indicated that the roof sign, in our view, would not have a negative impact on the surrounding area and would not adversely affect any adjacent residential premises.

The ward councillors have been notified of this request and have been provided with a copy of the report with the attached plan.

Conclusions:

It is the opinion of this department that the request for a minor variance for the proposed roof sign be approved as the intent of the sign by-law would not be compromised by the erection of that sign.
