On December 15, 1997 the applicant appealed to the Municipal Board citing Council's lack of decision within 90 days of receiving the application. On December 16, 1997, the Municipal Board consolidated this appeal with the above appeals on the Golden Mile Land Use Review.

On November 7, 1997, a pre-hearing held by the Ontario Municipal Board established parties, participants, issues, and date for the 2nd prehearing and hearing.

The owner has appealed the October 8, 1997 decision of the Committee of Adjustment refusing a minor variance to reduce the restaurant parking requirement on this site from 10 spaces per 100 m² (1,076 sq. ft.) to 8.4 spaces per 100 m². The variance would have enabled a total of 1 200 m² (13,000 sq. ft.) of restaurant space to be provided on this mixed commercial site. (The Committee did approve a second variance to reduce the office parking requirement from 3.5 spaces per 100 m² to the City-wide standard of 3 spaces per 100 m².)

The applicant has referred these applications due to Council's failure to make a decision on these applications. The applications propose to amend the Official Plan and Zoning By-law in order to permit a mixed use development comprised of 260 apartment units, 16 townhouses and a maximum of 6800 m² (73200 sq. ft.) of offices and retail uses.

Imperial Oil Limited has appealed Council's failure to make a decision on these applications within 90 days of their receipt. A Preliminary Evaluation Report on these applications considered by Council on June 24, 1997 directed that a Community Information meeting be held and that staff report back to Council on the results of the Community Meeting. The Community meeting has been scheduled for early February.

Green Desk Developments Inc. has appealed their application to permit the severance of a parcel of land into 2 parcels due to Council's failure to make a decision within 60 days of receipt of the application. This application is subject to a rezoning application Z97049 for which a Preliminary Evaluation Report will be considered by Scarborough Community Council in February 1998.

The abutting property owner to the west has appealed the December 17, 1997 decision of the Committee of Adjustment approving a variance to recognize the deficient building setbacks of an existing structure on the property.

The owner has appealed the December 17, 1997 decision of the Committee of Adjustment refusing a minor variance to permit reduced lot frontages and areas to accommodate division of the property into 2 lots. The Commissioner of Planning and Buildings has subsequently refused a consent to create the 2 lots.
