The Greens at Tam O=Shanter Inc.

138 Bonis Avenue

Part of Block 1, Registered Plan M-2255

Scarborough Agincourt

Tam O=Shanter Community

 

Purpose:

 

The application is for Draft Plan of Condominium approval for a 178-unit, 16 storey residential apartment building and seven multiple family dwellings nearing completion on the north side of Bonis Avenue, west of Kennedy Road (See Figures 1 and 2). A total of 312 parking spaces will be provided including 16 visitor parking spaces. An additional 85 surface and underground visitor spaces are available to the immediate east of the apartment building in the visitor parking lot of the existing Phase I Greens at Tam O=Shanter development at 168 Bonis Avenue (See Figure 3). The resident and visitor parking provided meets the minimum By-law parking requirement. The Condominium Description and Declaration for the Phase I development contains provisions with respect to shared visitor parking, recreation facilities, and necessary easements in favour of the apartment building currently under construction.

 

All technical agencies circulated had no comments or their requirements have been incorporated into the recommendations. There are no concerns under the current High Density Residential provisions of the Official Plan raised by this application, and the development complies with the >Apartment Residential= (A) and >Multiple-Family Residential= (M) zoning requirements of the Tam O=Shanter Community By-law. The development is being constructed in accordance with the Site Plan Control approval granted in November 1996, and represents the fourth phase of a five phase residential development on the north side of Bonis Avenue (See Figure 3).

 

Recommendations:

 

That Draft Plan of Condominium C97015 for The Greens at Tam O=Shanter Inc., with respect to 138 Bonis Avenue, being Part of Block 1, Registered Plan M-2255, be approved subject to the following conditions:

1. Plans as stamped ARecommended@ this date (Figure 2).

 

2. The owner to sign the City=s Standard Tax Agreement for payment of taxes and local improvement charges.

 

3. The owner shall be responsible for distributing ACondominium@ brochures supplied by the Works and Environment Department.

 

4. The owner to make satisfactory arrangements with the Public Utilities Commission with regards to water and electrical servicing, their acceptable completion, including any agreements and/or easements that may be required.

 

5. The owner to complete all conditions of the Site Plan approval prior to registration, or enter into a development agreement with the City, secured by a performance guarantee in a form and amount satisfactory to the City Solicitor, to guarantee completion of the site work if the owner chooses to register the condominium prior to completion of the project.

 

6. Prior to registration, the owner shall submit the final Condominium Description and Declaration for the approval of the Commissioner of Planning and Buildings with respect to all easements and rights-of-way to ensure mutual access between the apartment building and multiple family dwellings and 168 Bonis Avenue (Condominium Number 1027), for vehicular and pedestrian movements, visitor parking and servicing.
