Subject: REQUEST FOR FENCE BY-LAW EXEMPTION

Purpose:
The applicant proposes to erect a fence in the flankage yard abutting Parkview Heights at a height of 2 metres whereas By-law 24945 as amended permits a maximum height of 1 metre.

Recommendations:
That the Scarborough Community Council approve the construction of a fence at a height of 2 metres set back three metres (ten feet) from the curb abutting Parkview Heights.
Background:
The subject property is located at the north-west corner of Clonmore Drive and Parkview Heights and comprises a single dwelling with attached garage. As the owners, Mr. & Mrs. Aucoin indicate in their letter dated January 28th, they do not currently have a fence on the property and wish to erect one in order to provide a safe environment for their two young children.
Comments:
The property was inspected on January 21st. It was noted that there are no sidewalks along Parkview Heights abutting 16 Clonmore Drive and thus the problem of pedestrian safety with vehicles backing out of the driveway is not an issue. Parkview Heights runs north of the subject property and curves to the east, providing excellent sight lines for vehicles backing out of the driveway.
As noted on the sketch submitted by the owners, the proposal calls for the construction of the fence in a location set back 1.5 metres (5 feet) from the curb however the municipal road allowance extends approximately 5.7 metres (19 feet) back from the curb. Encroachments have been permitted in similar circumstances in the past with the understanding that the City may remove the fence for any reason at the expense of the owners. Owing to possible future needs of the City such as the construction of sidewalks, the erection of a fence 3 metres (10 feet) back from the curb would seem more appropriate. This set back distance will ensure adequate sight lines for traffic leaving the subject property and the property known as 2 Parkview Heights.
Under the provisions of Section 14 of By-law 24945 as amended a property owner may make application for an exemption from any provisions of the fence by-law.
