Subject: SITE PLAN CONTROL AND CONSENT APPLICATION PROCESSES

 

Purpose:

 

Outline current Scarborough Service Centre practices with respect to the Site Plan Control and Consent application processes.

 

Recommendations:

 

That the Scarborough Community Council receive this report for information.

 

Report:

 

In accordance with the policy and practice of the former City of Scarborough Council, and the delegated authorities granted to the Commissioner of Planning and Buildings, the following report outlines the Site Plan Control and Consent application processes currently in effect in Scarborough:

 

Consent Applications

In accordance with Section 54(2) of The Planning Act, authority to approve Consent applications has been delegated to the Scarborough Commissioner of Planning and Buildings.

 

  • The 12 members of the Scarborough Community Council are circulated a brief description of each consent application received. Those expressing interest will be kept advised of the status of the application.

 

  • Planning staff circulate the applications to the public (in accordance with the requirements of the Planning Act - normally all owners and tenants within 60 metres) and appropriate commenting agencies, and ensure that the Ward Councillors are advised of any issues arising.

 

  • If any member of Community Council raises an issue which cannot be resolved to the satisfaction of the Councillor and the Commissioner of Planning and Buildings, then the Commissioner prepares a report to the Community Council identifying the issues and requesting input from the Community Council.

 

  • The Commissioner approves or refuses the application, having regard for the Community Council=s input within the context and requirements of the Planning Act, and stipulates such conditions as may be appropriate.

 

  • The Commissioner provides, on each regular agenda of the Community Council, a report identifying all applications approved under this procedure, for the information of Community Council.

 

Site Plan Control Applications

In accordance with Section 41(13) of The Planning Act, authority to approve Site Plan Control applications has been delegated to the Scarborough Commissioner of Planning and Buildings.

 

  • The 12 members of the Scarborough Community Council are circulated a brief description of all new applications received.

 

  • Planning staff circulate the applications to abutting property owners and the appropriate commenting agencies and ensure that the Ward Councillors are advised of any issues arising.

 

  • Every member of Council expressing an interest in any Site Plan Control application is kept advised of the status of the application and provided opportunities to review plans and drawings.

 

  • The Commissioner advises the applicant and the Ward Councillors of his intention to approve the application.

 

  • If, within 10 working days, either the applicant or the Ward Councillor requests that the application be reviewed by Committee and Council, then no approval is issued by the Commissioner and the application is reported to the next available Community Council meeting. The Commissioner is guided by the Community Council=s input, within the context and requirements of the Planning Act.

 

  • The Commissioner issues such conceptual or final approvals as in his best judgement are appropriate.

 

  • The Commissioner signs any necessary agreements on behalf of the City, and, where he deems it to be in the public interest, requires that these agreements be registered on title.

 

  • The Commissioner provides, on each regular agenda of the Community Council, a report identifying all applications approved under this procedure, for the information of Community Council.

Best Practices:

The processes set out above are derived from the practices of the former City of Scarborough. Over the past several months, and continuing for the next few weeks, planning officials from the six former cities and Metro have been working to establish the Abest practices@ for the processing of development applications, and to develop recommendations for harmonized development review processes for the entire new City of Toronto. It is expected that recommendations for coordinated, consistent, and streamlined processes will be before Council for its consideration in March. In the interim, and to ensure timely and efficient approvals for the business community, the Scarborough Office will continue to follow the processes set out above.
