Background:
Noise By-law Exemption
By-law No. 24389, the Noise By-law, provides a procedure for the granting of an exemption from the by-law for a specified time period, not in excess of six months, and the exemption may contain such terms and conditions as the council sees fit. A public meeting is a requirement of the prescribed process.
In 1996, the former Scarborough Council granted an exemption for the years 1996 and 1997.
As a result of the 1996 Festival, the former Scarborough Council recommended certain actions be undertaken in conjunction with the 1997 Festival, including the implementation of a program, as recommended by Universal Light and Sound, specialists in sound and sound systems, to mitigate the effects of the noise. Additionally, the organizers worked closely with the Police from 42 Division to address the issues of traffic control, parking and crowd control.
These actions successfully addressed the concerns of the adjoining neighbourhoods.
Liquor Licence Board of Ontario (L.L.B.O.)
It is a requirement of L.L.B.O., that prior to the issuance of the special occasion permit for the Festival, that Council pass a resolution or the Clerk issue a letter advising the L.L.B.O. that the Festival is of AMunicipal Significance@, or a Community Festival. The former municipality of Scarborough had provided this support in past years.
