ANNUAL FESTIVALS

Purpose:
The purpose of this report is:
(1) to establish a date for a public meeting, as required by By-law No. 24389, the Noise By-law, to consider the application of The Greek Community of Metropolitan Toronto Inc. for an exemption from the Noise By-law for their annual Festivals for the periods July 1 to July 5, 1998, inclusive and August 21 to August 23, 1998, inclusive.
(2) to seek a Council resolution declaring the annual Festivals of The Greek Community of Metropolitan Toronto Inc. to be of AMunicipal Significance@.

Recommendations:
It is recommended that:
(1) the Scarborough Community Council schedule a public meeting for consideration of the application for an exemption from By-law No. 24389 at 9:30 a.m. on May 6, 1998; and
(2) the Scarborough Community Council recommend that the Council pass a resolution declaring the annual Festivals of The Greek Community of Metropolitan Toronto Inc. to be of AMunicipal Significance@, and direct the City Clerk to issue the appropriate letter to the Liquor Licence Board of Ontario.
Background:
Noise By-law Exemption
By-law No. 24389, the Noise By-law, provides a procedure for the granting of an exemption from the by-law for a specified time period, not in excess of six months, and the exemption may contain such terms and conditions as the council sees fit. A public meeting is a requirement of the prescribed process.
In 1997, the former Scarborough Council granted exemptions for two Festivals held during the periods June 27 to July 2, 1997 and August 22 to August 24, 1997.
The former Scarborough Council recommended certain actions be undertaken in conjunction with the 1997 Festivals, including the implementation of a program, as recommended by J.E. Coulter Associates Limited, consulting engineers in acoustics, noise and vibrations, to mitigate the effects of the noise. Additionally, the organizers worked closely with the Police to address the issues of traffic control, parking and crowd control.
These actions successfully addressed the concerns of the adjoining neighbourhoods.
Liquor Licence Board of Ontario (L.L.B.O.)
It is a requirement of L.L.B.O., that prior to the issuance of the special occasion permit for the Festivals, that Council pass a resolution or the Clerk issue a letter advising the L.L.B.O. that the Festivals are of AMunicipal Significance@, or a Community Festival. The former municipality of Scarborough had provided this support last year.
