The owner has appealed the February 11, 1998 decision of the Committee of Adjustment refusing a minor variance to permit a rear, one-storey addition having a minimum rear yard setback of 5.1 metres (16.7 feet), whereas a minimum rear yard setback of 7.5metres (25 feet) is required.

The owner of 4181 Sheppard Avenue East (south-west corner at Midland Avenue) has appealed By-law 25242, which established new zoning provisions for 4171 and 4181 Sheppard Avenue East. By-law 25242 represented the implementation of the land use and transportation study conducted in the Agincourt Centre area, and recommended a revised list of permitted commercial uses and Holding Provisions to address traffic constraints. The provisions of Official Plan Amendment 913 (Agincourt Centre Secondary Plan) relating to 4181 Sheppard Avenue have previously been referred by the Minister of Municipal Affairs to the OMB to be heard concurrently with the zoning appeal.
