Purpose:
The purpose of this report is to seek direction respecting an ongoing contravention of By-law 24222 as amended at
936 Port Union Road.
Financial Implications and Impact Statement:
If the fill and debris is directed to be removed under a work order issued by the municipality, the cost of such
action could be as high as $50,000.00.
Recommendations:
It is recommended that the Scarborough Community Council direct staff to call for tenders to remove the fill
material and debris at 936 Port Union Road and that the results of the tendering process be brought back to the
Community Council for review.
Background/History:
The property known municipally as 936 Port Union Road is a vacant lot located on the west side of Port Union
Road and north of Lawson Road. The file indicates that a number of actions have been initiated by the Property
Standards Division since October 1995. These actions have revolved around two issues which are long grass and
weeds and the accumulation of litter and debris. The issue of long grass and weeds has been handled through the
periodic issuance of notices and follow up work orders as required.
A large pile of fill material mixed with broken concrete block and other rubble has been stored on the lot for some
time. In October 1997, a notice under the Property Standards By-law was issued directing that the pile be graded
and maintained in a neat and tidy condition. There was no response to this notice and an Order to Comply was
subsequently issued on December 4, 1997. There was no appeal to this order which had a compliance date of
January 20, 1998 and charges have subsequently been initiated against the owner.
In the meantime, the Works and Environment Department was contacted and requested to provide an estimate to
remove the pile of dirt and debris. They responded that the material would have to be trucked to the Keele Valley
Landfill site and, as they do not have the resources or equipment to do the work, a contractor would have to be
hired. They provided an estimate of $50,000 to complete the work.
Justification:
The Order to Comply specifies that if the works are not completed within the specified time frame, the City may
carry out the repairs at the expense of the owner. The legislative authority is found in the Planning Act under
section 31, subsection 20. Such costs would be added to the assessment roll and collected in a like manner as taxes.
