Purpose:

This report recommends a schedule of public meetings for the removal of the Holding Provision (H) from the current zoning of the subject property, as shown on Figures 1 and 2. The owner of the property is seeking permission to allow the development of single-family and semi-detached dwellings, live/work units and commercial uses, over a portion of the overall Mondeo site.

Financial Implications:

None.

Recommendations:

1.That the Scarborough Community Council convene a Public Meeting, targeted for the fourth quarter of 1998, to consider removal of the Holding Provision (H) to allow development of the single-family and semi-detached dwelling component of the Phase II lands of the Mondeo Community, subject to:

1.The execution of the Subdivision Agreement; and

2.Staff providing Notice of the said public meeting to all owners and tenants within 120 metres (400 feet) of the subject property, at the applicant's expense.

2.That the Scarborough Community Council convene a Public Meeting or Meetings, targeted for the first quarter of 1999, to consider removing the Holding Provision (H) to allow the development of the live/work and commercial components of this application, subject to:

1.Staff concluding the review of the traffic study and the satisfactory completion of the transportation improvements necessary to accommodate development;

2.The execution of the Subdivision Agreement;

3.Staff completing the review of Site Plan Control applications for the live/work and commercial components; and

4.Staff providing notice of the said Public Meeting or Meetings to all owners and tenants within 120 metres (400 feet) of the subject property, at the applicant's expense.

Background:

In March 1996 Scarborough Council approved an Official Plan Amendment that created a new community known as "Mondeo". In September 1997 Scarborough Council enacted the current Zoning By-law standards on a portion of the westerly segment of the Mondeo land holdings (known as Phase II). The lands zoned in the second phase permit a variety of housing types: single and semi-detached dwellings, townhouses, and live/work units. As part of the overall community fabric, a commercial component to service the future population growth of the immediate area was also permitted. In order to ensure orderly development of the land, Council adopted the zoning permission subject to a Holding Provision (H), with requirements related to the Subdivision Agreement, Transportation Improvements and Site Plan Control approvals.

In the case of the single-family and semi-detached dwellings (Figure 2), the By-law allows for the removal of the "H" once the Subdivision Agreement has been executed. It is expected that the above-mentioned Agreement will be registered and executed shortly. It should be possible to convene the Public Meeting, to consider the applicant's request for removal of the "H", prior to year's end.

Regarding the applicant's request to remove the "H" from the live/work and commercial components, it is not anticipated that the conditions set out in the Zoning By-law will be satisfied until some time next year. In addition to the satisfactory execution of the Subdivision Agreement, the applicant is also required to implement any transportation improvements necessary to accommodate this development. As well, the removal of the "H" is subject to the review of a Site Plan Control application.

Presently staff are reviewing a Site Plan Control application (SS98065) for the live/work component. To date no Site Plan Control application has been submitted for the commercial component. The applicant has submitted an addendum to the initial Traffic Impact Study and it is currently being reviewed by staff. Planning staff have also received acknowledgement from Transportation Services Division staff that the required Transportation Improvements have been scheduled for completion by the end of 1998. Accordingly, staff propose that the Public Meeting or Meetings could be targeted for early to mid 1999 subject to satisfactory completion of the transportation improvements and completion of the review of the Site Plan Control applications for the live/work and commercial components.

As shown on Figures 2 and 3, the siting of the proposed Senior's building is partially located within the zoning line of the live/work units. This issue is being dealt with as part of a Zoning By-law Amendment application (SZ98009) and therefore, does not impact the ability of Council to deal with the request to lift the "H".

Benefits

This proposal will allow a portion of the Phase II lands of the Mondeo project to unfold by introducing a new variety of housing forms, single-family and semi-detached dwellings, to this development. It will also provide additional dwelling units to the City's overall housing stock.
