Toronto Hydro-Electric Commission

Bill 148: The Chairs of the public utilities commissions of the old municipalities on December 31, 1997, are Members of the Interim Toronto Hydro-Electric Commission until Council appoints new Members.

(Recommendation No. 74)

 

Early in 1998, a new Toronto Hydro-Electric Commission should be established with a clear mandate to expedite rate harmonization and restructuring.

 

The Commission should consist of at least 6 citizens and a maximum of 3 Councillors appointed by Council, including at least 1 who is a member of the Works and Utilities Committee.

 

The citizen anointments should be for a 3-year term with the Chair and Vice-Chair chosen annually by the Commission from among its members.

 

Criteria for appointments should be prepared reflecting the diversity of customers, the skills and expertise required on the Commission and the anticipated workload.

Immediate requirements: No political appointments required to maintain Interim Commission.

 

 

 

 

 

Based on Transition Team recommendations, Council needs to:

 

- decide on the composition of the new Toronto-Hydro Electric Commission; and

 

- adopt a by-law to establish the composition of the new Commission.

 

There are currently no political appointees on the Interim Commission

Bill 148: The Boards of both Cityhome and the Metropolitan Toronto Housing Company Limited (MTHCL) are continued until Council makes new appointments.

(Recommendations Nos. 78-80)

 

The Transition Team recommends that Council establish a single Toronto Housing Company that amalgamates the Metropolitan Toronto Housing Company Limited and Cityhome.

 

Council should move to create the new amalgamated organization as soon as possible. However, prior to establishing a permanent Board of Directors for the new Toronto Housing Company, the Transition Team recommends that an Interim Board be established according to the following:

 

- Each existing Board of Directors should be reduced to 7 members with the same 7 being appointed to both Boards (i.e. full cross-appointments).

 

- This 7-member Interim Board should comprise 2 members of Council, the current Chair of Cityhome, the current Chair of MTHCL and 3 citizens drawn from the existing Boards based on appropriate expertise.

 

The Interim Board should be replaced by a new Board of Directors for the new Toronto Housing Company within 6 to 9 months. The new Board should have 12-15 members composed of Councillors, community representatives and tenants, with a majority of citizens. The Chair of the amalgamated Board should be elected by its members.

 

At least one of the Councillors appointed to this new Board should be a member of the Community and Neighbourhood Services Committee.

 

The new City of Toronto should be the sole shareholder of the amalgamated Housing Company.

 

Immediate requirements: Council appointments required.

 

 

 

 

 

Based on Transition Team recommendations, Council needs to:

 

- establish an Interim Board as outlined in Recommendation No. 79;

 

- amend the by-laws governing Board composition of the MTHCL and Cityhome to allow the interim group to serve as the Board of Directors for each organization; and

 

- decide on the composition of the new Board of Directors for the new Housing Company within 6 to 9 months.

 

 

 

 

Note: The Boards of both Cityhome and the Metropolitan Toronto Housing Company Limited recommended that the Interim Board have a membership of 9, including 2 tenant representatives consisting of 1 from each of the existing Boards.

 

This joint recommendation differs from the composition proposed for the Interim Board in Recommendation No. 79 of the Transition Team.

- the 7-Member Interim Board comprise 2 members of Council; and

Toronto Board of Health

Bill 148: The Chairs of the existing Boards of Health on December 31, 1997, shall be the Members of the Interim Board until Council appoints new Members.

 

Health Protection and Promotion Act: The Board will consist of between 3 and 13 members.

 

 

(Recommendation No. 81)

 

A new Toronto Board of Health should be appointed as quickly as possible.

 

The new Board of Health should have a balance of City Councillors and citizens who reflect the diversity of their communities and bring a variety of skills and expertise.

 

At least 1 of the Councillors appointed to the Board should be a member of the Community and Neighbourhood Services Committee.

 

The Chair of the Board should be elected by the Members of the Board.

Toronto Public Library Board

Bill 148: The Chairs of the existing library boards on December 31, 1997, are members of an Interim Board until Council appoints new members.

 

Section 67(2) of Bill 148 states that the Board shall be deemed to be a public library board established under the Public Libraries Act.

 

Public Libraries Act: The Board shall consist of between 9 and 15 members appointed by Council, subject to the following:

- 2 members shall be recommended by the Board of Education;

- 1 member shall be recommended by the Separate School Board;

- the number of Council members appointed to the Board cannot be more than the majority less 1.

 

Section 10 (3) of the Public Libraries Act states that a board member shall hold office for a term concurrent with the term of the appointing Council, or until a successor is appointed, and may be reappointed for one or more further terms.

 

(Recommendation No. 82)

 

Council should appoint a new Toronto Public Library Board early in 1998 with appointments to include a majority of citizens. Members should reflect the diversity of their communities and a variety of skills and expertise.

 

At least 1 of the Councillors appointed should also be a member of the Community and Neighbourhood Services Committee.

 

The Chair of the Board should be elected by the Members of the Board.

Immediate requirements: Council appointment required.

Toronto Transit Commission

Bill 148: Members of the TTC in office on December 31 remain in office until Council appoints new members.

 

The Bill continues provisions of the Metro Act allowing the size and composition of the TTC to be determined by Council by-law.

 

Section 25 (2) states that a member shall be appointed for a 3-year term.

 

Section 25(6) of Bill 148 states that "the appointment of a member requires the affirmative vote of at least two-thirds of the members of the council present and voting".

 

(Recommendation No. 83)

 

Citizen members should be included on the 7-member board of the TTC, with City Councillors in the majority.

 

The Chair of the TTC should be a member of City Council, a member of the Urban Environment and Development Committee and one of Council's appointments to the proposed Greater Toronto Services Board.

 

Council should request an amendment to legislation to delete the requirement for a two-thirds vote to appoint members to the Toronto Transit Commission. A simple majority should prevail.

 

Immediate requirements: Council appointments required.

 

Appointments to the TTC require a vote of at least two-thirds of the members of the council present and voting.

 

 

Based on Transition Team recommendations, Council needs to:

 

- decide on the composition of the Commission;

 

- revise the by-law establishing the composition of the TTC to include citizen representation; and

 

- request the Province of Ontario to enact the appropriate legislative amendment to reduce the term of office from 3 years to 18 months, and to delete the requirement for a two-thirds vote to appoint members to the Commission.

As a priority, City Council should appoint 3 Councillors to the Board.

 

Council will make its citizen appointment when the term of a current citizen member of the Board comes due.

 

Immediate requirements: Council must appoint members according

to the Board composition set out in legislation.

 

 

 

 

 

Based on Transition Team recommendations, Council will need to:

 

- appoint 3 Members of Council to the Board (including the Mayor, or if the Mayor chooses not to be a Member of the Board, another Member of Council); and

 

- make its citizen appointment when the term of a current citizen member of the Board comes due.

 

(Note: The next term of office to expire for a citizen member on the Police Services Board is May 1998.)

Toronto Licensing Commission

 

(Toronto Licensing Tribunal - Proposed by the Transition Team)

Bill 148: Section 79 provides that the Metropolitan Licensing Commission is continued under the name Toronto Licensing Commission.

 

The members of the Commission on December 31 remain in office until Council appoints new members.

 

Section 79(2) provides that the commission is composed of:

- the Mayor or designate;

- two or more persons appointed by Council.

 

 

 

(Recommendation No. 99)

 

Council should integrate the administrative functions of the current Metro Licensing Commission into the City administration, and establish through Council by-law a Tribunal made up exclusively of Council-appointed citizens.

 

The Tribunal should be mandated with the quasi-judicial functions currently performed by Commission members.

 

The Transition Team suggests that the current citizen appointments should be requested to continue to act as members of the Licensing Commission until such time as the Toronto Licensing Tribunal is established and membership appointments are made by Council.

 

(Recommendation No. 70)

 

As a general rule, citizen appointments should be for the full 3-year term of Council.

 

Immediate requirements: Council appointments required.

 

 

 

 

 

 

 

Based on Transition Team recommendations, Council needs to:

 

- establish a Toronto Licensing Tribunal made up exclusively of Council-appointed citizens;
