Note: The Municipal Act states that a Business Improvement Area Board of Management shall:

 

"consist of such number of members appointed by council as the council considers advisable, at least one of whom shall be a member of the council and the remaining members shall be individuals assessed for business assessment in respect of land in the area or nominees of such individuals or of corporations so assessed.".

 

The general practice has been to appoint the Ward Councillor.

The new Council should request the Province to amend section 220 of the Municipal Act to:

 

- ensure that the notice of the enactment of by-laws to authorize the creation of a BIA is expanded to include all business occupants; and

 

- permit the special charge to be levied against ratable property in the area which would have to be divided as premises of businesses enumerated on the special assessment roll prepared for levying the rate.

 

In addition, legislative amendment is required to remove the requirement for Council to appoint a political representative to BIAs.
