 Subject:Part of No. 110 West Toronto Street, Ontario Municipal Board Decision/Order, Official Plan Amendments Nos. 78 and 100 and Zoning By-law No. 1997-0480 (Davenport)

  Purpose:

 Summary of Ontario Municipal Board Decision and Order acknowledging withdrawal of two appeals and dismissing the third of 3 appeals respecting the proposed Maxi and Co. retail warehouse.

 Council Reference/Background/History:

 At its meeting of August 21, 1997, the City of Toronto Council amended and adopted, as amended, Clause No. 11 of Report No. 12 of the Land Use Committee. At its meeting of September 22, 1997, Council enacted Official Plan Amendment No. 100 and Zoning By-law No. 1997-0480 respecting the proposed Maxi and Co. retail warehouse on part of No. 110 West Toronto Street. As part of the Loblaws appeal, Official Plan Amendment No. 78 was also before the Board.

 Comments and/or Discussion and/or Justification:

 The City Solicitor and a planner from Urban Development Services attended at the Ontario Municipal Board for a second Pre-hearing Conference on January 21, 1998.

  Two of the appellants, Loblaw Properties Limited and the Bloor Junction Neighbourhood Coalition of Toronto Inc. had withdrawn.

 The last outstanding appeal of Edna Hudson, on behalf of the Toronto Region Architectural Conservancy, was dismissed by the Board pursuant to Section 34(25) of the Planning Act without a hearing for failing to make oral submissions at the public meeting or written submissions to Council before the by-law was passed. A copy of the decision/order is on file with the City Clerk.
