Application to Remove Three Trees Situated on Private Property (Midtown)
Purpose:
An application has been filed under the provisions of City of Toronto Municipal Code, Chapter 331, Trees, Article III, for a
permit to remove three trees situated on the above noted private property, in order to facilitate the construction of eight (8)
residential townhouse units behind an existing nineteen (19) storey apartment building at 50 Prince Arthur Avenue,
Toronto.
Recommendations:
That if Toronto Community Council approves the request for the removal of the three trees noted below, that such approval
be conditional on: 1.the trees in question not being removed or injured until permitted construction and/or demolition related activities in
accordance with plans approved under Official Plan Amendment and Rezoning Application No. 197026 commence which
warrant the removal of the trees; and 2. the applicant planting a minimum of sixty-two (62) large growing shade trees, in accordance with the landscape plans
prepared by Acme Environmentals, dated stamped as received on September 29, 1997 by Urban Development Services and
on file with the Commissioner of Urban Development Services.
Comments:
I have received a request from Mr. Peter Prattas of Miller Thomson, Barristers and Solicitors, on behalf of 1213763 Ontario
Inc., c/o Wedcor Holdings Inc., 625 Evans Avenue, Suite 100, Toronto, Ontario, M6W 2W5, the owner of the subject
development property, that the City consider the removal of three trees situated on the above noted private property. The
request forms part of Official Plan Amendment and Rezoning Application No. 197026 for the purpose of facilitating the
construction of eight (8) residential townhouse units behind an existing nineteen (19) storey apartment building on the
above noted property
As required under Section 331-13.B. of Municipal Code Chapter 331, Trees, Article III, a >Notice= of application sign was
posted on the property for the minimum 14 day posting period. At the time of writing this report, twenty seven (27) letters
were received in response to the notice of application to remove the trees in question.
The three trees in question are as follows:
1.56 and 64 cm diameter twin-stem White Elm in good condition;
2.42 cm diameter Mulberry in fair condition;
3.84 cm diameter Silver Maple in fair condition.
All three trees require a permit and the consent of City Council to remove or injure.
The proposed development in its present form precludes the retention of the three trees noted above due to the size and
scale of the development.
The landscape plans which form part of the development application indicate the planting of sixty-two (62) large growing
shade trees throughout the development site.
Should the Community Council recommend that the request to remove the trees in question be approved, such approval
should meet the conditions outlined above in my recommendation.
