Subject: Società - Request to Extend the Hours of Operation for the Boulevard Cafe on the Roxton Road Flankage of 796 College Street (Trinity-Niagara)

 

Purpose:

 

To report on the applicant’s request to extend the hours of operation for the boulevard cafe on the Roxton Road flankage of 796 College Street from 10:00 p.m. to 12 midnight, Sunday to Thursday, and from 11:00 p.m to 1:00 a.m., Friday and Saturday.

 

Funding Sources, Financial Implications and Impact Statement:

 

Not applicable.

 

Recommendation:

 

The Toronto Community Council may recommend that:

 

(1) (a) City Council approve the extension of hours of operation for the boulevard cafe on the Roxton Road flankage of 796 College Street to 12 midnight, Sunday to Thursday, and to 1:00 a.m., Friday and Saturday, as requested by the applicant; and

 

(b) Should City Council approve an extension of the hours, I be requested to report back after the end of the 1998 cafe season on the operation of the cafe under the extended hours;

 

OR

 

(2) City Council deny the request for an extension of the boulevard cafe hours on the Roxton Road flankage of 796 College Street.

 

Background:

 

Messrs. Michael Camara and Stanley Raposo, owners of Società, 796 College Street, Toronto, Ontario M6J 2X4, have requested an extension of operating hours of their boulevard cafe from 10:00 p.m. to 12 midnight on Sunday to Thursday, and from 11:00 p.m. to 1:00 a.m. on Friday and Saturday. As City Council approved the current operating hours, they must authorize any change.

Comments:

 

The former City of Toronto Council, at its meeting of March 24 and 25, 1997, approved the application for a boulevard cafe on the Roxton Road flankage of 796 College Street, subject to the applicant complying with the criteria set out in § 313-36 of Municipal Code Chapter 313, Streets and Sidewalks, of the former City of Toronto Municipal Code and to the following restrictions:

 

(a) serving time limits of 10:00 p.m. during Sundays and weekdays, 11:00 p.m. on Fridays and Saturdays;

 

(b) no music or amplified sound on patio at any time;

 

(c) owner to prevent any noisy parties or patrons from staying outside on the patio; and

 

(d) the permit be reviewed with deputations at the City Services Committee in March 1998.

 

City Council, at its meeting on April 16, 1998, in considering the department’s report (February 27, 1998) entitled "Società - Operation of the Boulevard Cafe During the 1997 Cafe Season - Roxton Road flankage of 796 College Street", adopted the report and directed that the licence be renewed annually by staff under the present terms and conditions.

 

Messrs. Michael Camara and Stanley Raposo of Società, in their letters of May 26 and June 25, 1998, (Appendixes ‘A’ and ‘B’), requested that the hours of operation be extended to 12 midnight, Sunday to Thursday, and 1:00 a.m., Friday and Saturday.

 

The City Clerk’s office has notified the owners and occupants within 120 m along both sides of Roxton Road from the cafe, advising of Messrs. Camara and Raposo’s proposal.

 

Conclusions:

 

As indicated in the former Director’s report to your Committee dated February 27, 1998, during the 1997 cafe season, the operation of the boulevard cafe was monitored periodically. Our inspections confirmed that the proprietor complied with the restrictions and other requirements of § 313-36 of Municipal Code Chapter 313 of the former City of Toronto Municipal Code, indicating the closing time restrictions.

 

In addition, we did not receive any complaints from members of the public or Toronto Police Service pertaining to noise or other disturbances at the subject location.

 

 

 

On hearing the deputations, the Toronto Community Council should decide whether or not to recommend that City Council grant an extension of the boulevard cafe hours for the boulevard cafe on the Roxton Road flankage of 796 College Street.
