Subject:56 Hunter Street, Toronto, Ward 26 (East Toronto) - Municipal Code, Chapter 331, Article III, Trees

Purpose:

An application for a permit to remove three trees on private property in order to construct a new house and garage has been filed by Mr. Grant Paisley, Box 85, Goodwood, Ontario, L0C 1A0, owner of 56 Hunter Street.

Recommendations:

Either 1 or 2 below.

1) Issue a permit for removal of the trees conditional on: i) the issuance of a demolition permit and a building permit for the construction of a new house and garage at 56 Hunter Street and ii) the applicant agreeing to plant two replacement maple trees once construction is completed.

2) Refuse to issue a permit to remove the trees requiring the applicant to redesign or abandon his plans for construction of a new house and garage.

Comments:

The trees in question are thirty-one and thirty-two centimetre diameter Ailanthus altissima and a thirty-three centimetre diameter Siberian elm, all in fair condition. The two Ailanthus trees are located at the northeast and northwest corners of the existing house and as a result, if a new house is to be constructed, there is no possibility of adequately protecting either tree during construction. The elm tree is located in an area that conflicts with a proposed garage and it would also not survive the proposed construction. There are two additional elm trees on the mutual property line of 56 and 54 Hunter Street that are to be protected if permits are issued to construct a new garage.

The trees requiring removal for the proposal to take place are common in the City's urban forest and their removal conditional on replacement planting with two large growing shade trees such as maple would be an acceptable option in the opinion of urban forestry staff.

A notice of application sign was posted on the property for the required 14 day posting period, in order to notify the neighbourhood and provide an opportunity for objection to the application. Two written objections were received in response to the application to remove the trees in question. Copies of these letters have been forwarded to the Community Council Secretary for the Community Council to review.
