Subject:Request for an Exemption from Municipal Code Chapter 400, to Permit Front Yard Parking at 155 Silver Birch Avenue (East Toronto)

Purpose:

To report on a request for an exemption from Municipal Code Chapter 400, Traffic and Parking, of the former City of Toronto Municipal Code, to permit front yard parking. As this is a request for an exemption from the by-law, it should be scheduled as a deputation item.

Funding Sources, Financial Implications and Impact Statement:

Not applicable.

Recommendation:

1.That City Council deny the request for an exemption from the by-law to permit front yard parking at 155 Silver Birch Avenue, as such a request does not comply with Chapter 400 of the former City of Toronto Municipal Code;

OR

2.That, should the Toronto Community Council consider this proposal, this report be deferred to the February 1999 meeting of the Toronto Community Council, and the Commissioner of Works and Emergency Services be requested to report at that time on the results of a poll for the hearing of deputations.

Background:

Councillor Tom Jakobek, in his communication of September 16, 1998, together with a communication dated September 14, 1998 from Ms. Liette Philibert, 155 Silver Birch Avenue, Toronto, Ontario M4E 3L3, requested that I review front yard parking at 155 Silver Birch Avenue and report the findings to the Toronto Community Council.

Comments:

The current front yard parking criteria of Chapter 400 of the former City of Toronto Municipal Code prohibits front yard parking where permit parking is authorized on the street, or the property is situated within an area authorized for permit parking.

Permit parking is authorized on the even side of this portion of Silver Birch Avenue, within permit parking area 9C.

In areas of the City without permit parking, the Commissioner may issue a licence for front yard parking subject to certain physical criteria being met, as long as a public poll has been conducted on the street, and the majority of ballots cast are in favour of the request.

No public poll has been conducted for this location.

The location meets the physical criteria of Municipal Code Chapter 400, Traffic and Parking, of the former City of Toronto Municipal Code. However, I should note that in order to accommodate the parking of a vehicle in the front yard, extensive grade change (2.2 m) is required. In order for this grade change to be approved, the applicant will be required to submit plans which will be circulated to the various public utilities to determine if any underground services will be affected by the proposal. Any underground utilities that will be affected by the proposed reduction in grade, may require relocation and the full costs to be paid by the applicant.

Conclusions:

As the property is situated on a street authorized for permit parking, this location is not eligible for front yard parking. Under the circumstances, this request should be denied by Council.
