Subject:Appeal of Denial of Front Yard Parking Application at 156 Golfview Avenue (East Toronto)

Purpose:

To report on the applicant's appeal of staff's refusal of an application for front yard parking at 156 Golfview Avenue, which does not meet the requirements of Municipal Code Chapter 400, Traffic and Parking, of the former City of Toronto Municipal Code. As this is an appeal and a request for an exemption from the by-law, it is scheduled as a deputation item.

Funding Sources, Financial Implications and Impact Statement:

Not applicable.

Recommendation:

That City Council deny the request for an exemption from the by-law to permit front yard parking at 156 Golfview Avenue, as such a request does not comply with Chapter 400 of the former City of Toronto Municipal Code.

Background:

Councillor Tom Jakobek, in his communication of October 28, 1998, together with a communication dated October 19, 1998 from Mr. John Leca, owner of 156 Golfview Avenue, Toronto, Ontario M4E2K5, requested an appeal to staff's decision to refuse the application for front yard parking, and asked me to report to the Toronto Community Council.

Comments:

Mr. John Leca, owner of 156 Golfview Avenue, submitted an application on September 25, 1998, through Councillor Jakobek's office, for front yard parking fronting the property.

City Council, at its meeting of October 28, 29 and 30, 1998, approved amendments to former City of Toronto Municipal Code Chapter 400 to permit front yard parking for locations where permit parking is not authorized fronting the property.

Permit parking is authorized on the even side of this portion of Golfview Avenue, within permit parking area 9C. Currently, there are no on-street parking permits available and the installation of a ramp to service this property will result in the loss of an on-street permit parking space. There are 220 people on the wait list for permit parking. In addition, there is 1 permit issued to a resident of 156 Golfview Avenue.

This location does not meet the new amendments approved by City Council at its meeting of October 28, 29 and 30, 1998, as permit parking is authorized on the even side of the street.

Conclusions:

As the property is situated on a street where permit parking is authorized on the same side of the street, and the installation of the ramp will result in the loss of an on-street permit parking space, this location is not eligible for front yard parking. Under the circumstances, this request should be denied by Council.
