Subject: Amendment to City of York Interim Control By-law 3432-97

Lands - 2007, 2009 and 2011 Lawrence Avenue West

Purpose:

 

To extend , for an additional year, the prohibiton applying to the subject lands as imposed by Interim Control By-law 3432-97 . The By-law prohibits the location of any new Banquet Hall on the lands until April 1, 1997.

Recommendations:

 

It is recommended that:

 

(1) The Interim Control By-law relating to 2007, 2009, and 2011 Lawrence Avenue West be extended for an additional year.

 

(2) That Council, at its meeting of March 4, 1998, enact a By-law to amend Interim Control

By-law 3432-97 to implement Recommendation (1).

 

(3) That the Solicitor bring forward the necessary By-law for enactment.

 

Council Reference/Background/History:

 

On April 2, 1997, Council adopted a resolution to study the provisions of City of York Zoning By-law 1-83 relating to Banquet Halls as they apply to 2007-2011 Lawrence Avenue West. Council also passed an Interim Control By-law to prohibit any new banquet hall from locating in the industrial condominium complex located on the lands. The Interim Control By-law is in effect for one year and expires on April 1, 1998.

 

Comment:

 

The review of the Zoning By-law definitions and standards relating to Banquet Halls is incorporated into a broader study of restaurants and other eating establishments. A report on the study is expected to be presented to Community Council in April, 1998. This timing will not allow for the enactment of a by-law amendment to implement any of the report=s recommendations to change zoning provisions relating to Banquet Halls prior to the expiry of the Interim Control By-law on April 1, 1998.

 

Should the Interim Control By-law lapse this year, there will be an opportunity for other banquet halls to locate on the subject site, prior to any new By-law standards being put in place. The Interim Control By-law would be repealed when the new By-law on eating establishments is in effect.

 

3.0 Conclusions:

 

The Interim Control By-law for the subject properties should be extended for another year to allow for the by-laws on eating establishments to be in full force and effect prior to lifting the restrictions on the subject property.
