23.Sidewalk Repairs in the Vaughan Road and Arlington Avenue Area

Purpose:
York Community Council at its meeting held on February 18, 1998, requested that staff proceed to take appropriate action
with respect to repairs to sidewalk between 389 to 397 and 396 to 400 Vaughan Road.

Internal memo, dated January 14, 1998, from Councillor Joe Mihevc, Ward 28, York Eglinton, to York Community
Council requesting repairs to the sidewalk in front of 389-397 and 396-400 Vaughan Road.
Comments and/or Discussion and/or Justification:
The sidewalk on the east side of Vaughan Road south of Arlington Avenue, between 397 and 389 Vaughan Road, is in
good condition without toe trips (see Appendix I). The concrete apron from the back edge of the public sidewalk to the face
of the building from 389 to 395 Vaughan Road is of private construction and in state of disrepair. The apron is the
responsibility of the abutting owner/occupant to maintain.
As well, the photos taken show vehicles parked illegally on the boulevard which in all probability has caused much of the
deterioration, as the existing concrete apron was not designed for vehicle load.
The public sidewalk at the above location is 1.52 metres (5 feet) wide and the private concrete apron varies in width from
3.05 metres (10 feet) at No. 395 to 7.92 metres (26 feet) at No. 389 Vaughan Road (see Appendix II).
On the west side of Vaughan Road, just south of Arlington Avenue, the public sidewalk in front of 398 Vaughan Road has
cracks in four bays but there are no deviations to cause a hazard to pedestrians (see Appendix III).
The concrete apron behind the public sidewalk from 396 to 400 Vaughan Road is cracked with some minor deviations. At
398 Vaughan Road there is a Consumers Gas cut which has not been permanently repaired and this is the Utility=s
responsibility to restore. As indicated above, the private concrete apron is not the City=s responsibility to maintain. The
public sidewalk at this location is 1.52 metres (5 feet) wide. The private concrete apron varies in width from 396 to 400
Vaughan Road (see Appendix IV).
Conclusions:
Maintenance of public sidewalks is the responsibility of the City. Therefore, the sidewalk in front of 398 Vaughan Road
will be repaired in the 1998 construction season.
The maintenance of the concrete apron immediately behind the public sidewalk is the responsibility of the abutting owner.
