BY-LAW No. -1998
To authorize the execution and registration of a plan of survey
for the acquisition of a limited interest in and over lands
for drainage easement purposes - Wychwood Park.
WHEREAS the Council of the Corporation of the City of Toronto, at its meeting held on
August 21, 1997 by its adoption of Clause 16, City Services Committee Report No. 10, as amended,
which report was further amended by the adoption of Clause 55 of Executive Committee Report No.
25 on December 8, 1997, authorized an application for the expropriation of a limited interest in and
over lands at Wychwood Park for drainage easement purposes;
WHEREAS Council approved the application and authorized the appropriate City Officials
to take the necessary actions to effect the expropriation of a limited interest in and over lands at
Wychwood Park for drainage easement purposes; and
WHEREAS By-law No. passed on the 17th day of April, 1998, expropriated a limited
interest in and over lands at Wychwood Park for drainage easement purposes, which lands are shown
as PART 1 on Plan of Survey SYC1130 prepared by Walter Kowalenko, City Surveyor, on the 24th
day of February, 1998; and
WHEREAS the Expropriations Act requires the execution of the plan of survey by the
expropriating authority and its registration in the proper land registry office;
The Council of the City of Toronto ENACTS as follows:
1. (a) The Chief Financial Officer and Treasurer or designate and the City Clerk or
designate are authorized to sign the plan of survey, and the City Clerk or designate
are authorized and directed to affix the seal of the City of Toronto; and
(b) When signed and sealed, Walter Kowalenko, City Surveyor, is directed to cause Plan
of Survey SYC1130 to be registered in the Land Registry Office for the Metropolitan
Toronto Registry Division (No. 64) and the Commissioner of Corporate Services is
authorized and directed to give notice of the expropriation in accordance with the
Expropriations Act.
2. Plan of Survey SYC1130, attached, shall form part of this By-law.
