The North York Community Council recommends that the Conditional Building Permit issued by the Chief Building Official, North York Civic Centre, for this application be revoked.



Further details of this matter are forwarded to Members of City Council under confidential cover.



The North York Community Council reports having also requested:



(1) the Commissioner of Urban Planning and Development Services and the City Solicitor to review this situation and provide a report for consideration at the Council meeting scheduled for April 16, 1998, at which time this matter will be considered;



(ii) the City Solicitor to also report to the City Council meeting of April 16, 1998, on the legal liability of the City having moved to revoke this Conditional Building Permit; and



(iii) the Chief Building Official, North York Civic Centre, in future to notify the local Councillors immediately a request for a Conditional Building Permit is received.



Background:



The North York Community Council discussed, in camera, the matter of a Conditional Building Permit being issued to Symphony Square (Royal Mansions) despite the fact that there was still one condition outstanding for the site plan approval; namely that one of the local Councillors wished to have a community meeting prior to the site plan approval being finally signed off. The applicant had entered into an agreement requiring it to obtain site plan approval by May 25, 1998, among other things, failing which the Conditional Building Permit would be revoked.
