BY-LAW NUMBER

  to designate the Malvern Primitive Methodist Cemetery

Plan 217, Lot 21 & 23

under the Ontario Heritage Act

as being of historical and architectural value

   WHEREAS the Ontario Heritage Act, R.S.O. 1990, Chapter O.18 as amended, authorizes the Council of a municipality to enact by-laws to designate real property, including all the buildings and structures thereon, to be of historical and architectural value or interest;

 AND WHEREAS the Council of the City of Toronto has caused to be served upon the owners of the lands and premises known as the Malvern Primitive Methodist Cemetery property more particularly denoted in Schedule "A" hereto and upon the Ontario Heritage Foundation notice of intention to so designate the aforesaid real property and has caused such notice of intention to be published in a newspaper having a general circulation in the municipality once for each of three consecutive weeks;

 AND WHEREAS the reasons for designation are set out in Schedule "B" hereto;

 AND WHEREAS no notice of objection to the said proposed designation has been served upon the Clerk of the municipality;

 THEREFORE THE COUNCIL OF CITY OF TORONTO ENACTS AS FOLLOWS:

 1.The real property, more particularly described in Schedule "A" hereto, known as the Malvern Primitive Methodist Cemetery, is hereby designated as being of historical and architectural value or interest.

 2.The City Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in Schedule "A" hereto in the proper Land Registry office.

 3.The City Clerk is hereby authorized to cause a copy of this by-law to be served upon the owner of the aforesaid property and upon the Ontario Heritage Foundation and to cause notice of this by-law to be published in a newspaper having general circulation in the City of Toronto.

SCHEDULE "B" TO BY-LAW

 REASONS FOR THE DESIGNATION OF THE "MALVERN PRIMITIVE METHODIST CEMETERY"

 Malvern Primitive Methodist Cemetery is recommended for designation for historic reasons.

 The site was the location of the only church structure to serve Scarborough=s early settlers in the crossroad community known as Malvern. Built in 1864, the frame Methodist Church was demolished in 1975 and only the stone memorials located in the church cemetery remain as reminders of those who lived and worked in what was once the thriving community of Malvern.

 The cemetery is closed to future interments and includes only a small number of graves. However, the remaining monuments are memorials to the pioneers of Malvern village including members of the Badgerow, Burton, Ormerod, Pearson and Robbins families.

 Because no church remains on the vacant site and there is little else remaining of old Malvern village, the cemetery is recommended for designation for historic reasons.
