Bill No. 371

 BY-LAW No. -1998

 To stop up and close part of the public highway Simcoe Street abutting premises 172 to 190 Simcoe Street and to authorize the conveyance thereof to The Canada Life Assurance Company.

  WHEREAS by Clause 1 of City Services Committee Report No. 10, adopted by the Council of the former Corporation of the City of Toronto at its meeting held on August 21, 1997, it is recommended that part of the public highway Simcoe Street abutting premises 172 to 190 Simcoe Street be stopped up and closed as a public highway and that the portion of Simcoe Street so stopped up and closed be conveyed to The Canada Life Assurance Company upon the terms and conditions contained in Clause 9 of City Services Committee Report No. 11, adopted as amended by the Council of the former Corporation of the City of Toronto at its meeting held on September 16, 1996.

AND WHEREAS notice of Council's intention to stop up and close the said portion of Simcoe Street and to convey the same as aforesaid was advertised in a daily newspaper on June 23, 30, July 7 and 14, 1997.

 The Council of the City of Toronto HEREBY ENACTS as follows:

 1.Part of the public highway Simcoe Street, described by W. Kowalenko, Esq., O.L.S., as follows:

 In the City of Toronto and Province of Ontario, being composed of part of the Public Highway Simcoe Street, formerly William Street, on Plan 1-49-55 designated as Parts 2 and 9 on Plan 64R-15600, both said Plans being in the Land Registry Office for the Metropolitan Toronto Registry Division (No. 64)

 The northerly limit of Queen Street West and the westerly limit of Simcoe Street as confirmed under the Boundaries Act by Plan BA-1093 (Instrument CT258877)

 is hereby stopped up and closed as a public highway.

 2.The soil and freehold of the portion of the highway stopped up and closed by section 1 of this By-law shall be conveyed to The Canada Life Assurance Company upon the terms and conditions contained in Clause 9 of City Services Committee Report No. 11, adopted as amended by the Council of the former Corporation of the City of Toronto at its meeting held on September 16, 1996.

 ENACTED AND PASSED this day of July, A.D. 1998.
