Bill No. 411

 BY-LAW No. - 1998

 To layout and dedicate certain land north of Pullan Place extending between Simcoe Street and St. Patrick for public highway purposes and to name that land Simcoe Street.

 WHEREAS Municipal Act Subsection 305(2) provides that the laying out of highways less than 20 metres in width requires the approval of the Minister of Municipal Affairs and Housing; and

 WHEREAS by Ontario Regulation 143/95 and By-law No. 59-97 of the former Municipality of Metropolitan Toronto that approval was delegated to the Planning Commissioner of the former Municipality of Metropolitan Toronto; and

 WHEREAS the Ministry of Municipal Affairs and Housing has confirmed that City of Toronto Act, 1997 (Bill 103) is sufficient authority for the City to self-approve the laying out of highways which are less than 20 metres in width under the existing regulatory scheme; and

 WHEREAS the enactment of this by-law reflects the approval required under By-law No. 59-97 of the former Municipality of Metropolitan Toronto;

 The Council of the City of Toronto HEREBY ENACTS as follows:

 1.Certain land north of Pullan Place extending between Simcoe Street and St. Patrick Street, described by W. Kowalenko, O.L.S., City Surveyor, as follows, namely:

  In the City of Toronto and Province of Ontario, being composed of part of Lot 9 on the west side of William Street, now Simcoe Street, and part of Lot 9 on the east side of Dummer Street, now St. Patrick Street, on Plan 1-49-55 designated as PART 8 on Plan 64R-15600 both said Plans being in the Land Registry Office for the Metropolitan Toronto Registry Division (No. 64).

 The westerly limit of Simcoe Street and the easterly limit of St. Patrick Street as confirmed under the Boundaries Act by Plan BA-1093 (CT258877).

 is laid out and dedicated for public highway purposes and named Simcoe Street.

 2. This by-law is approved under the authority of By-law No. 59-97 of the former Municipality of Metropolitan Toronto for the purposes of Ontario Regulation 143/95 and Municipal Act Subsection 305(2).

3.Section 1 of this By-law does not come into effect until the conveyances to the City of the lands described in Section 1 and the necessary land registrations respecting those conveyances are completed.
